Continuation - Discussion of the Amanda Knox case

hearsay

Please present EVIDENCE that the files were denied to the defense. Here are some examples of evidence:

1. Swore statement from those who signed the open letter that they were personally refused access to these files. If they were not personally refused by the prosecution or the court then it is nothing but heresay.

2. Motions presented to the court by the defense asking for the files and motions from the prosecution denying the request.

Just prove that the defense ASKED and that the prosecution said NO.

Alt+F4,

Elsewhere (4:57 PM) you wrote, "Good gosh, when did I ask for a court motion in Italian? If you have a good translation in English then post it"

In asking for motions, you are necessarily asking for documents in Italian. Would you trust a translation? By the tone of your comments, I have to wonder. You seem to be concerned that Krane and others went through the defense attorneys with their request, making their claims of being refused heresay. Why would the defense mislead or lie to its own consultants?

On the subject of Sara Gino's comments, I would ask you how it is possible for her to have the electronic data files and not have the dates.

I would agree that it is an honest answer but I don't feel it is the most accurate answer. I would say a better answer is that it is almost certain the defense was not provided the fsa files.

ETA: Halkides gave that Comodi quote on 23 October:

They have withheld certain data, but that is really a secondary point. It's possible to say, on the basis of what we do know, that the most significant DNA evidence against Amanda and Raffaele is unreliable. I have posted guidelines for handling DNA evidence, put out by the US Dept. of Justice:

- Wear gloves. Change them often.
- Use disposable instruments or clean them thoroughly before and after handling each sample.
- Avoid touching the area where you believe DNA may exist.
- Avoid talking, sneezing, and coughing over evidence.
- Avoid touching your face, nose, and mouth when collecting and packaging evidence.
- Air-dry evidence thoroughly before packaging.
- Put evidence into new paper bags or envelopes, not into plastic bags. Do not use staples.

These guidelines have been developed because if they are not followed, the results of the DNA tests may not be reliable. We have all seen the video that shows two people touching the exact spot where Raffaele's DNA was supposedly found. And we know this result was announced to the public the day after Raffaele's father went on national TV with proof that Raffaele's shoes did not match the shoe prints at the crime scene. They sifted through the rubble they had created at the crime scene and came up with exactly the evidence they needed most. Isn't that a lucky coincidence???

Charlie, I thought he was already retired from the FBI. What job did he give up? He supports Amanda and Raffaele on a full time basis?

He was in charge of security at Pepperdine University, which has a campus in Italy. They were afraid Steve's activity might lead to problems for their students and personnel, so they gave him an ultimatum: give up your support of Amanda and Raffaele, or resign. He refused to do either so they fired him.

Why would Steve's support of Amanda and Raffaele lead to problems for Pepperdine students/faculty in Italy? Is their campus in Perugia?

I'm rather interested in the answer to that as well, that statement by the Pepperdine official was rather bizarre. I can think of a number of reasons they might have made it, and most of them are weird.

No, no, Rose! It's "SOP" for the Italian police to collect evidence in this slipshod and unprofessional fashion! I'm surprised you didn't know this!

BTW, who knew that it was popularity of visits which made web sites develop coding faults and go down? That must be why Google and Youtube are always down....... ;)

Does anyone know what is going on at PMF? I have NEVER posted there but have just visited to read a section of the Motivations report as I wanted to check something before posting about it here. However, I am coming up against a message which simply states:

''You do not have the required permissions to read topics within this forum.''

Why is this? Surely they have not banned 'guests' from reading the threads as well now? Or have they simply exceeded their bandwidth or something?

All of us could frame AK and RS. Just surreptitiously get a DNA sample from each. DNA is on hair roots. Look for hair with roots in the shower, sink, or interrogation room. Then chop up the root and mix it with a drop of very diluted water soluble glue. Next we paint it on a knife or a bra clasp. It would be totally invisible to the naked eye.

Once the forensic lab is given the props, they would discover the 'evidence' we've fabricated. After that we act like magicians. We concoct a story to distract the attention of the audience. Presto! Out of the magic hat come two guilty people.

The country that framed the innocent people could trade the framed ‘guilty’ people for captured spies.

My point is only that faming a suspect is so easy that even a child could do it. The great Randi could, if he wanted, pull so much evidence out of his magic hat that nobody would ever suspect they were innocent.

Who did all this? Does America have Italian spies?

That is strange. Why would you need to register to even look at a topic or a document? That would tend to discourage people from visiting, in my opinion. Maybe Michiavelli can answer that question when he returns.

"My name is Steve Moore; I retired from the Federal Bureau of Investigation (FBI) in 2008 after 25 years as a Special Agent and Supervisory Special Agent. My entire investigative experience was in the investigation and prosecution of violent crime, from murder to mass-murder and terrorism. In my last such assignment, I was the Supervisor of the Al Qaeda Investigations squad, following which I ran the FBI’s Los Angeles-based “Extra-Territorial Squad”, which was tasked with responding to any acts of terrorism against the United States in Asia and Pakistan. I have investigated murders throughout the United States and the world.

In my career, I have worked closely with the Indonesian National Police (INP), the Pakistan Rangers, the Sindh Police (Karachi, Pakistan), the National Bureau of Investigation (NBI) of the Philippines, the Philippine National Police (PNP), the Royal Bahamas Police Force (RBP) and various police agencies in Greece, Thailand, and other countries. I have lectured on investigative techniques and terrorism at the International Law Enforcement Academy (ILEA) in Bangkok, the Pacific Training Institute in Angeles City, Philippines and Honolulu, and terrorism conferences throughout the US and other countries. I have taught officers from such diverse countries as the People’s Republic of China, Bermuda, Brunei, Taiwan, Malaysia and Sri Lanka. I also served as a (term) Legal Attaché at a U.S. Consulate overseas. I do not look down at foreign police forces. I appreciate the differences in our approaches, but what is never different between our agencies is the reliance on logic, reason and credible evidence.

I have spent years participating in prosecutions; two years on one death-penalty trial alone. There are several people who will die in prison, in part because of investigations that I have conducted and testified to. I have received four awards from the United States Attorney’s Office for excellence in investigation. I was nominated in 2002 for the FBI’s top award for Terrorism Investigations. I am educated in the art of evaluating evidence and testimony. To put it bluntly, I know “**** from Shinola”.

Take my word for this. Investigation of violent crimes is my life; not a hobby. The case the Italian prosecutors are trying to sell you is not the beautiful thing it appears to some to be. It’s a junker all cleaned-up and waiting to be purchased by naïve people. And the jury in Perugia bought it."

Argument from authority?

Exactly.

I am hoping that it is just a 'temporary blip' and there is something wrong with the coding or something (as LJ may have been inferring).

He used FB (Facebook) contacts rather than FBI contacts. He has examined all the crime scene video from Nov 2 and 3 as well as several hundred high-resolution photos and other direct evidence. This guy is a bona fide expert who spent 25 years as an FBI agent. He feels so strongly about Amanda and Raffaele's innocence that he gave up his job rather than abandoning his support for them.

So because he feels strongly about this and was willing to sacrifice his job his opinions have more weight than others?

He (Draca) was asked for some info. and background for Steve Moore by Alt+F4. That was why he then provided those links. I am sure you would have seen the post from Alt+F4 as Draca quoted it when answering in the post you decided to quote.

If you say that you are only referring to Mr. Moore's comments, don't you think that he is merely establishing some credibility so that readers know that it is not merely anyone picked up off the street (or park bench for that matter) speaking/writing. Moore probably felt it relevant to mention the points he did (such as 25 years etc) and I would have thought that most neutral observers can see that quite clearly.

I'm rather interested in the answer to that as well, that statement by the Pepperdine official was rather bizarre. I can think of a number of reasons they might have made it, and most of them are weird.

Their Italian campus is in Florence. They can't come out and say, "we're afraid the authorities might retaliate for Steve Moore's activities by causing problems for our students and personnel." But that's the underlying concern.
