Total Hypothetical. What if Trump died in the next few months.

Or not. None of these guys pick VPs that are really presidential material. They pick people they think will drag a few more votes in.

In situations like this, that quality of the current candidate is mostly irrelevant, it's the wave of sympathy for the deceased which is critical.

Criminal cases are automatically extinguished by the death of the defendant.

Some civil causes of action are extinguished by the death of either party. The death of the plaintiff in a defamation suit, for example, extinguishes the cause of action—you cannot defame the dead. For those that are not immediately extinguished, a representative of the decedent's estate must file a motion with the court for substitution and the court decides whether sufficient interest (generally standing along the lines of Article III) remains to allow the action to proceed with a substitute party. Failing any such motion, the cause of action is usually then dismissible upon a motion from the surviving party.

Well yeah, I was talking about the cases against co-defendants and co-conspirators. In civil cases then sure, you can sue their estate/heirs. Rare but not all entirely uncommon.

Mitch McConnel would have an earth-shattering orgasm.

Seriously, the republican party has been seriously screwed over by Trump. Yeah, he won in 2016, but was a one term president (when most presidents put together at least 2 back to back terms). He also was probably a factor in the republicans losing control of congress in 2020, and in a failure to make much headway in the 2022 midterms. Plus, he tends to suck up a disproportionate share of political donations that are going to pay for his legal fees instead of campaign ads, etc. However, Moscow Mitch and the other "traditional" republicans do not have the integrity to actually do anything about it. (They are terrified of alienating the MAGAchud by doing anything that would directly confront Trump.)

GOP leadership would be ecstatic if Trump died. They won't have the albatross of Trump hanging around their neck, and they won't have to worry about the backlash of Trump supporters if they tried to force Trump out.

Personally I am most interested in what sort of "honors" would be bestowed upon him. Will they name any navy ships after him? What about schools? (Supposedly there are 2 public schools named after Nixon. I could see a few schools in deep-red states called the "Donald J Trump public school".)

I am sure politicians like MTG and Gym Jordan would push for stuff to be named after Trump, which would be opposed by the Democrats.

Democrats would be wise to make an effort to name every new landfill and sewer treatment plant after Trump. "The Donald F. Trump Public Landfill" has a nice ring to it.

The problem is, Sewer Treatment Plants have a valuable purpose... they take dangerous waste and convert it into something relatively safe. That seems to be the opposite of what Trump does.

They could create a few new national parks and name them after Trump. Maybe create the "Donald Trump national Park" at the site of the Ohio train derailment where all the toxic waste got spilled. Or maybe rename some lakes to be "Trump Lake" where they found coal-ash contamination.

This is an insightful comment.

Yeah, it's telling that all the Trump acolyte candidates seem to be mostly marginal figures. If Trump exits the scene I would likewise assume that the party itself would re-establish their grip on the right wing movement, rather than being whipsawed around by some other MAGA leader.

Not to say that it would be a return of pre-Trump Republican policies and aesthetics though. The MAGA movement has left its stamp on the party and I guess anyone who tries to take leadership will have to at least pander to this powerful base of the party, but I imagine they could do so while still being a team-player for the Republican party in a way that Trump isn't.

All the aesthetics of Trump and MAGA without the chaos of Trump's bucking of the party machine.

The silver lining of Trump was that he wasn't too bright and seemed more reactive than someone who plans ahead. It really could have been much worse, and I assume the next charismatic fascist that climbs to the top of the right wing political world will be much more cunning and vicious.

That's why they would have to be named posthumously, after he has for the first time in his life done the same thing.

It would be the opposite of wise, it'll probably happen. They do that then the Reps start doing the same with the likes of Kennedy, Clinton, Carter, etc. Our politics is stupid and petty enough.

Yup. Trump brings in the stupid/bigot vote, which as we have seen, is no longer a joke, so the GOP can't turn its back on them. Trump dying alleviates all their PR problems without alienating any block of voters. Then the search ramps up to find T2: a smarter, more palatable Trump (no, it's not going to be DeSantis).

Loving "The Trump Dump". I can see Port-a-Potties adopting the name, too.

Are you seriously suggesting that Republicans still have lows which are too petty for them? In 2023? "Dems shouldn't do X or Reps will do X back!" lost its luster about the tenth time the GOP did it anyway first chance they got.

I'm pretty sure someone has suggested naming a wastewater treatment plant after W. Clinton. It went knowwhere. I'm just suggesting its stupid and petty and when it starts, there's no limiting principle. If the Dems go there, then the Reps definitely will.

No, they won't, or they'd be doing it already. They don't do it now because it wouldn't work. Instead of seething in impotent fury like they would be in the circumstance, the honoree would just be given a platform to talk about the importance of investments in sanitation.

If you say so, apparently this is the one dumb petty ploy that would only shore up the base and alienate everyone else that they won't stoop to but ok.

Not to mention, the argument, "the opposition will do any bad thing so we should also to dumb petty bad things" not exactly compelling.

If trump dies after a conviction, a tried and convicted traitor (Documents case or Georgia case). Does he still get a 'state' funeral?

I hate to quote myself but this is a serious question. Does anyone know? Google doesn't.

I doubt there is a rule, so likely depends on who's in power but probably yes.

ETA:

As a small "r" republican I don't think we should have state funerals at all, seems the founders largely agreed the first official state funeral in the US was William Henry Harrison of all folks.

Thanks for that.

I'll make sure I'm dead drunk that day and miss it all. The mere thought of it makes my stomach churn.

ETA: For a convicted traitor? The nearest we have to trump is Guy Fawkes, we burn his effigy every year to celebrate his death.

Retaliatory naming of cesspits and such like after a political rival is probably petty and counterproductive, because there's always political mileage in it for somebody somehow.

A better outcome with Trump would be to ensure his name is never used for anything. Remove it as far as possible from public consciousness. No Trump Tower, no Trump library, no monuments, no parks, no statues, no buildings, no landfills, no cesspits...nothing. Let his memory fade rapidly by leaving no trace that could be worshipped. Yesterday's newspaper...

To be clear, Trump is merely a Terrible human being and threat to democracy, not yet a convicted traitor.

My preferred result is that trump fades into obscurity. Too late for that but it would be nice.
