I'm still looking into this part but it has been suggested that the first appearance before the magistrates is in a strictly administrative capacity. When the sovereign states his lawful position by not accepting the court officers' legal position at face value and asking for remedy the officers will leave to reconvene a 'new' court, this time in Admiralty. If the sovereign again states his capacity and asks for cure and maintenance the magistrates will leave for a 2nd time and reconvene as an Ecclesiastical court at which point you ask again for remedy and claim your sovereignty with God.

Where do they get their ideas from?

You know, sometimes when I read the DI threads I am stunned at the amount of stupidity that people will believe in. Where do they get it from? All of this legal mythology appears to be from the same woo promoters: John Harris, Rob Menard, etc.

I mean - really? The judges enter and leave in some sort of magical attempt to "reconvene" a court into admiralty and then "ecclesiastical" court? Even though neither of these types of courts exist in the courts the FMOTL enter into? I'm not even sure what a ecclesiastical court is, but for all of their hand wringing over admiralty court the truth is they've never been in one and never will be unless they happen to push the FOTL woo while in international waters!

It's Rock-Scissors-Paper. Freeman beats Administration, Admiralty beats Freeman, Cure and Maintenance beats Admiralty, Ecclesiastical beats Cure and Maintenance, and God beats Ecclesiastical....All we need to do is figure out how Administration beats God, and we can complete the Loop of Stoop(id), and we can continue like this forever. Not only do we never have to pay our debts, we also create Perpetual Motion!

So this women receives a summons to appear in court in order to accompany her daughter who is under 17 and charged with an assault offense.

In response, after much google lawyering and reading of FOTL woo, she sends a hand written letter back to the court clerk stating that because the summons has her daughters name in CAPITAL LETTERS its a legal fiction and thus neither she nor her daughter have to show up. She also states in her letter that a summons is merely a "invitation" to appear and as a sovereign she declines the invitation.

As always, she declares victory because she practiced FOTL woo and didn't receive a response from the court. Of course, what really happened is they just filed the letter away and will issue a outstanding warrant for her arrest after the court date, and she will find herself hauled to jail the next time she gets caught for a minor traffic offense or has any other interaction with the law.

Lets look at the outcomes:
1) By practicing FOTL woo, she is going to make things worse on her daughter and find herself being hauled to jail on an outstanding warrant for failure to respond to a summons, plus she'll end up paying court costs.
2) If she would have actually been in tune with reality, she would have showed up to court and helped get her daughter's charge reduced. Nothing would have been on her own criminal record.

As always, all they do is make things harder on themselves by practicing the FOTL woo.

That is quite the brilliant idea, we should work on that. Can you imagine the comedy that would ensue?

Interestingly, the wiki on admiralty courts says the following:
In recent years, a conspiracy argument used by tax protesters is that an American court displaying an American flag with a gold fringe is in fact an "admiralty court" and thus has no jurisdiction. Courts have repeatedly dismissed this as frivolous.[2]

But..if we could get them to commit a maritime tort...the gold fringed flags would be legitimate!

This is probably the worst bit of BS the FoTLs promote, as it enables all the other BS. The notion that people can set arbitrary deadlines for the courts to respond to their nonsense, which if missed means they have "won" something, is behind all this crap. It lets people like those above to post a "victory" story, while allowing the frauds and nutcases to ignore the inevitable follow-up, when the court gets around to actually acting.

How many times have we seen this play out now?

A friend used to work in social security. One of their jobs was taking benefit frauds to court. It used to be quite routine for the police to turn up with other warrants for the defendants. Apparently they often didn't actively pursue warrants because it was cheaper (and pretty much as effective) to just wait for the person to be picked up for something else, since people who have broken the law in the past are likely to break it in the future.

As far as i can gather this whole FOTL stuff is absolute twaddle with a capital TWAD.:jaw-dropp

Are there any cases of this crud working because it all seems to be hypothetical and many of the FOTL posters appear to know of it hypothetically but not actually in court.

We have a legal system that has evolved through 100's of years and I would have thought that these arguments over jurisdiction and sovereignty and legal entities would have been well sorted out by now.

So is this thing the worst conspiracy waffle ever, due to the fact that it would appear you get into more trouble if you try it, or some light hearted fun that we can laugh at like Apollo hoaxers:D or Chemtrailers.:D

Hey, the bottom line is that the FOTL fools are De Facto Anarchists who just avoid using that label, and are not against the idea of government, they are just agains any form of government that has ever been tried or has ever been suggested.

FOTL fails in court. Every time. It does not work.

The harm potential for FOTL is high. Anyone who relies on it will be in a world of legal trouble. Those who profit from selling it rarely rely on it; they merely profit (or try to) from the harm they cause.

It's bad all around.

As you can tell by the number of stars, quite a few fellow woos agree with him. Yet again, I stand amazed that we can take something SO SIMPLE as the census and the paranoid nutters will find a reason to paint it as sinister.

His first "argument" is that there is a trademark by the United States name on the envelope. Of course, in conspiracy world this means the united states IS a corporation (instead of having a corporation) and since corporations are evil this must be evil. The benign and actual explanation, of course, is that the government trademarks the name "United States Census" because they don't want it to be used by people to scam others, and if you have a trademark its all that easier to persecute someone on multiple counts.

And it just gets worse from there. Much, much worse.
