Cont: Roe v Wade overturned - this is some BS part II

And in the meantime people, mostly women, will suffer and die.

Yes, of course, and even if, after a pettifogger's wet dream of delays and diversions and dissimulations the corrupt and cupidinous adjudicasters passing for a Supreme Court find a rivet missing in the boilerplate, the State will just rewrite the law and try again until the merely outrageous becomes the new fallback from the totally obscene.

The particulars of this case don't seem to be great.

I just read about it here:

https://www.theguardian.com/us-news/2023/nov/01/idaho-mother-son-kidnap-charges-abortion

The girl said that she was “happy” to learn she was pregnant, but said Kadyn Swainston told her that he would not pay child support and that the relationship would be over if she gave birth, court records show. The girl also said that Rachael Swainston made the arrangements for the girl to have an abortion. Rachael Swainston told the girl that Kadyn Swainston would get in trouble because he was over 18, and threatened to kick her out of the house if she revealed she was pregnant to her parents, police said.

The problem(s) seem to include statutory rape, sexually explicit images of a minor, pressuring her to have an abortion even though she didn't want to, threatening to withhold child support, end the relationship, and kick her out of the house if she didn't comply. So maybe not the most sympathetic of defendants. (There were also some drug charges for good measure). Note that the girl who had the abortion was not charged.

Frightening! The right-wing is turning this country into 1984 Big Brother territory. Idaho is one of the most right-wing states in the country.

From my understanding, it wasn't in real time but they accessed their phone records afterward to see what cell towers they were pinging on the relevant dates.

This can't be. I was assured by right-wingers in the forum that all of this was just hyperbole by the lefties...

In a landmark victory for abortion rights in America, Ohio voters have voted to enshrine abortion rights into the state's constitution by a wide margin. The ballot initiative, also known as Issue 1, is an amendment that guarantees a constitutional right to abortion and other reproductive care in Ohio.

This after Ohio lawmakers passed a six-week abortion ban, which included no exceptions for rape or incest.

Outstanding!

Not only did Issue 1 enshrine into the Ohio constitution the absolute right for women control their own bodily autonomy as regards abortion, it also enshrines the rights of all Ohioans to use birth control, which was another right under attack from Christo-fascist evangelists and their enablers, far right Repugnicans.

One of the statistics in this chart will really put the fear Gawd into Repugnicans...

... the top one. That is a wholesale botty-smacking, and that group is the future of elections. No wonder the Repugnicans want to screw over the youth vote as much as they can. I'm surprised they are not trying to raise the voting age back to 21!!

There will be downstream effects too, such as the opening of new (and continuing operation of existing ) abortion clinics, with the doctors and staff assured there will be no prosecutions.

This is really, really going to chap the collective arses of those extreme Republican misogynists and anti-abortion morons. Those clinics and their staff had better take security measures seriously, because we know both from history and from recent events, that the right is fully prepared to use violence to try to get their way. The so-called "pro-life" movement (an oxymoron if ever there was one) has shown themselves to be well capable of bombing clinics and murdering doctors.

The Republican talking heads (I think on CNN) got called out for their reaction. They have been saying for years that abortion should be left to states. Now they want to start a discussion about limits and exceptions. The host basically said "Wait a minute - you wanted it decided by the states. Tonight they decided, and NOW you want to discuss?"

The Ohio amendment mentions up to the date of viability, with exceptions after that.

I remain skeptical that state level abortion laws will survive the current SCOTUS.

I share your pessimism in the face of outright totalitarianism being the goal of all republicans, but how can they find a reasonable lie to hang their decision on?

I know they are literal theocratic monsters in the Saudi tradition, but can they **** this up?
Legally?

I also know that their foot soldiers will resort to violence.

Speaker of the House, Mike Johnson

I didn't notice the Jewish Defense League rushing to censure him for his comments.

Why should they? While I disagree completely with his statement, it's not directed at Jews nor is it Holocaust (capital H) denial. He's using the word 'holocaust' (lower case h) correctly as far as its definition: "destruction or slaughter on a mass scale".

A TX court allowed a TX woman with a nonviable pregnancy to get an abortion. TX AG Ken Paxton has threatened any doctor who performs the procedure with legal action saying the court order “will not insulate you, or anyone else, from civil and criminal liability,” including first-degree felony prosecutions and civil penalties of at least $100,000 for each violation." What POS. Kate Cox is 20 weeks pregnant. Her fetus was diagnosed with a fatal genetic condition, trisomy 18, and will live, at most, a few days after birth.

Texas Attorney General Ken Paxton has asked the state Supreme Court to intervene and stop a Dallas woman from having an abortion.

Paxton’s office petitioned the high court just before midnight Thursday, after a Travis County district judge granted a temporary restraining order allowing Kate Cox, 31, to terminate her nonviable pregnancy. Paxton also sent a letter to three hospitals, threatening legal action if they allowed the abortion to be performed at their facility.
This is the first time an actively pregnant adult woman has gone to court to get an abortion since before Roe v. Wade was decided in 1973.
The central question is whether a lethal fetal anomaly qualifies a pregnant patient for an abortion under the narrow medical exception to the state’s near-total abortion ban. Cox’s lawyers argue that continuing this nonviable pregnancy poses a threat to her life and future fertility, thus necessitating an abortion.

Travis County District Judge Maya Guerra Gamble agreed, saying it would be a “miscarriage of justice” to force Cox to continue the pregnancy. The state disagreed, telling the Supreme Court that Guerra Gamble’s ruling “opens the floodgates to pregnant mothers procuring an abortion” beyond the scope of the medical exception.

Paxton wants to make this poor woman continue with a pregnancy and give birth to a child who will not live. He wants to make a baby go through go through dying rather than terminate a 20 week fetus. He makes me want to vomit.

Cruelty is the objective; you can bet your salary that Paxton's mistress would have no issue getting an abortion is need be.

Paxton has made it clear, that he will go after the doctor, the husband and anyone inside or outside of her family who assists her in any way in getting this court-ordered abortion.

Does anyone here still believe RecoveringYuppy's assertion that women need not take any security precautions with their personal information and/or online footprint when seeking an abortion?

No, cruelty is the plan - cruelty and control over women. You can tell this is true by the number of "pro-lifers" that are also "anti-birth control". You can tell Republicans are not at all interested in the children once they are born. They oppose and vote against legislation that would support pre and neonatal care; they oppose and vote against measures to make the lives of needy children better, they oppose and vote against child tax credits.

- The more pregnant women who are forced to term against their will, the easier it is to inflict economic hardship on them.
- The more women who are forced into economic dependence, the fewer there will be who will find a way to escape an abuser.
- The more women in poverty, the more control and domination there is over them.
- The more raped women who are denied the right to terminate, the more they will be inflicted with trauma and narrowed options.
- The more raped under-aged girls who are forced to term, the more they will themselves be collateral desperate dependents.

Anti-choice is the hard mechanics of misogyny - the cruelty is the mathematics of control.

Doctors aren't god, they could be wrong, a miracle could happen, only god can make such decisions about life and death. Apart from of course the death sentence.
Or a cop accidentally shooting dead the wrong person.
