Ed Olympic swimmers may have lied about being robbed

If this is true (and I believe it is) then those swimmers (Jack Conger and Gunnar Bentz) should be just fine. On the other hand, Feigen looks to be n a whole lot of trouble.

Lesson #1: Never....Ever....Lie to the Police. Only talk to the Police when YOUR Lawyer is present. Otherwise, STFU!

Perhaps in the legal sense, but they could have come forward and offered the truth at any point in the last four days.

Here's some advice: If you do not have a lawyer, then STFU! Those young men did the right thing by staying silent.

Remember - anything you say to the police can be twisted and used against you. This is why you don't talk to the police without YOUR lawyer present.

First of all, don't lie to your mom. If you do lie to your mom, better to own up to it to her than compound the error exponentially by lying to the police.

Conger and Bentz are not necessarily in the clear.

Rio police just said that it is premature to think that there will be no charges for the four. Two forms of charges could come: lying to the police, and vandalism of the gas station.

Police are asking all four to please make public apologies. But that is not in exchange for being charged. Start now by apologizing to the world. Do it quickly.

Compared to the charge of filing a false Police Report, the Vanadalism Charge is a joke.

Furthermore, apologies are not in order: they are an admission of guilt. Only a stupid lawyer would advise his client to do it.

Hey...this is Lawyering 101 I'm talking about here. If you have any doubts about what I am saying, then run it past a real Criminal Defense Lawyer - and they'll agree.

The swimmers that made it back to the US are probably in the clear:

The United States and Brazil share an extradition treaty allowing for the exchange of criminals charged with various crimes, including murder, rape, malicious wounding and other offenses.

Falsifying a police report in Brazil is punishable by up to six months in detention or a fine, but the misdemeanor charge is not listed in the extradition treaty.

And how is that working out for them? The next day after the robbery story broke, they could have gone to US Olympic authorities and told the truth. They would then give true facts to the Brazilian police and been on their way. The only thing the Brazilians are pissed about is the fabrication of the robbery story which is all on Lochte.

They should just front up.

Apologise for wasting police time and it will all blow over

Lots of people in prison who thought they could talk themselves out of a bad situation without a lawyer. Sometimes, people find themselves in positions where they can't talk thier way out of a jam - then they just STFU and wait for thier lawyer (if they are smart).

Ask Martha Stewart how well "talking" worked out for her.

Another admission of guilt.

Why not just volunteer to go to prison?

I doubt they would go to prison for anything if they apologise. It isn't crime of the century

Stern telling off and warning to make the cops look tough and all over rover

Only one made it back to the USA, he is Lochte Ness Monster.

Do it only if the DA has offered your lawyer an acceptable deal - and only then.

Apologizing at the request of the Police is an admission of Guilt with no deal included (Police can't make deals - although they will most often lie and say they can).

Again Lawyering 101.

The great thing about this forum is the wide variety of expertise of its members. For example, who would have thought that we would have experts on Brazilian law here?

You're wrong. What I am saying applies to any legal system.

However, let's assume you are right. If so, then an American's utter ignorance of the Brazillian Judicial System would even be more of an incentive to keep their mouths shut until they can find an attorney - wouldn't it? And this is basically what I've been saying: STFU and get a Lawyer!

Some sources say that the sentence for lying to police in Rio is 6 months in prison. Other sources say that it is 3 years. Maybe it's a 6 month minimum and a 3 year maximum. I don't know but I've definitely seen both figures.

What happened to the days when Rock Stars could get their buzz on, trash a suite or bathroom, pay the damages and just laugh it off?

How sad. :(

:p

These boys screwed up. If reports hold up (this is very loose and may include the station manager hiding some profit)... they coughed up about $30 in local currency (Reals?) and a US $20 and were on their way.

Easy peasy and a drunk-bro story for back home.

Instead we get a minor int'l incident. :boggled:

Pillocks.
