KSM to be tried in NYC

How about this: What if several legal motions are made to dismiss the case because he was tortured and coerced as per US law?

Or....we can just throw those silly pre 911 laws out and proceed with a kangaroo USSR-Nazi Germany style charade and hope nobody notices....Yeah!! That's the ticket...

Are you going to do anything about this injustice?

They most certainly do have a place. Have you forgotten that we're at war with Terrorist or did that slip your mind?

The guy is a Truther, what do you expect?
Of course he supports KSM and probably Bin Ladin as well, since in his eyes they were patsies and the Evil US Guvment did it.

I know he's a Truther! :D

I expect to see some kind of evidence, but that's not gonna happen while we're all still alive.

Feelings here are - naturally - running high. But, a serious question ....
KSM will go on trial in NY. Reports on TV tonight suggest he will not only plead guilty but has actively requested the death sentence if found guilty. I can't find a quick reference to that on the 'net, but never mind.

What is his status, and that of the case against him, under US law given that he was tortured at Guantanamo? Would all evidence bar confession 'evidence' at Guantanamo still be admissible? Would those responsible for the torture automatically become open to prosecution themselves by virtue of KSM being trial on US soil?

Basically what I'm asking is this - suppose this were a routine (forgive me) 1-on-1 homicide case with overwhelming prima facie evidence against the accused but that the accused had been tortured while in custody, how might this affect the progress of the case, in purely legal terms?

$50 says they cry cover up because they aren't allowed to interrogate...err, wait....intimidate? hmmm no that's not it...oh wait interview the jurors during the trial. yeah that's it, they're just asking questions.

They aren't going to use or need any evidence they gained from torture, afterall, KSM did confess before he was captured, and after the waterboarding. Of course you'll come up with a lame excuse like all truthers do.

And I'm sure there's a boatload of evidence on his laptop, oh and there's this

um, you mean like the kangaroo-court truthers wanna set up for Bush, Cheney, Rumsfeld, Wolfowitz, Silverstein, Guiliani, and Rice?

Chewy, the purpose of having trials is to find out if the person charged is actually guilty. We have laws against torture and coercion because admissions or confessions gained in such a fashion are not considered reliable(for obvious reasons.) Also, there are valid reasons why a defendant must be able to confront any evidence or witnesses against him in open court and on the record. In addition the rules of evidence and discovery should be completely intact. If any elements of our system of justice are ignored, the "trial" is a farce and everyone in the world who is not stupid will know. I believe that if this trial is conducted in an open and legal fashion, we will get closer to what really happened on 911 and who was really behind it. I am looking forward to seeing what happens here. I am cautiously optomistic that the conspiracy behind 911 will begin to unravel partly as a result of KSMs trial.

Thanks

Ummm that's only public opinion about torture & coercion. There's no laws yet that I know of that makes them un-nessesary.

Public opinion worldwide:

You don't want to know who did it & why, you've never really looked for any type of evidence that could prove you right.

Yes it will, KSM will be reminded that he will spend the rest of his miserable life in a cell, locked away from his family, especially his children (if any).

I would certainly want Bush, Cheney, Rumsfeld, Wolfowitz or anyone else including these "alleged" terrorists who are about to be tried in NY to have complete and fair due process under US laws in ANY trial. I don't know of ANY "truthers" who are against the US Constitution or due process under it. Can you name any truthers who support "kangeroo courts"? Please provide evidence of this. Thanks

Well Jack, If it comes from Faux News...It must be the gospel truth. Also ALL of those assertions that you have just made are allegations which must be proved beyond a reasonable doubt in a legal court of law with all the rules of evidence and discovery intact. What Sean Hannity and Bill O'Reilly spew shouldn't be considered evidence pal. We'll just have to wat and see, won't we. Thanks

Who said anything about throwing away those laws. You are babbling nonsense.

In a post 911 world, those silly laws about tortured and coerced confessions and rules of evidence and discovery have no place, right Chewy? Why even bother having these silly trials? We need the "Super Deluxe Patriot Act", which would once and for good free our courts and law enforcement heros from all these cumbersome impediments.

Onward Patriots!! AWAY...

I think anything that was obtained SOLELY from torture likely will be thrown out. I am betting they still have plenty to convict him with, including his confession prior to his capture and the testimony of others. Stop whining about the "Patriot Act", last I checked people were still free to go about doing just about anything they want, Patriot Act or not. Take your sign, put it in the trash can, grow up, and start a meaningful contribution to society.

lol...I challenge you to return to that quote above when the trial is finished. I will be the first in line to tell you you were wrong, and once again encourage you to stop with the silly evidenceless based CTs and do something productive with your life.

Why would you have Bush, Cheney, Rumsfeld, or Wolfie charged? Because you don't like them? I ask, because I have not seen a SINGLE PIECE OF EVIDENCE against them in terms of having an active role in orchestrating 9/11, so on what basis would you have them brought to trial oh wise one?

Fox News is complete and utter crap 90% of the time. This makes your stupid truther theories no more correct. You will find the vast majority of posters here are actually left of Fox News by a long shot. Not gonna work playing the "neocon shill" card here.

If KSM has a good lawyer we'll find out if the DODs evidence as written up in the pdf from faux news is any more credible than those phony OBL tapes that keep turning up whenever the DOD is asking for another couple hundred billion to fund their phony war on terror. My guess is that there is a pretty good possibility that all this "evidence" is manufactured like so much of the other so called evidence in this case. We'll just have to see what happens in court. Thanks

How can they "manufacture" KSM's hard drive on his laptop?

He had almost every single attack made by Al-Quida on there, including the plans for 9/11.

How many lies are you going to tell us JMH? Are you & Galileo family members?

We shall see indeed. And exactly what will you folk's reaction be if no lawyer can prove any of the evidence is manufactured? Will you say, "well, you know, these guys might be guilty after all"? No. You'll continue to whine and moan on relatively obscure internet forums about inside job and faked evidence and corrupt lawyers.

It's because NO amount of evidence could ever convince you of something you were predisposed to believe in from the get-go.

LOL! This a DOD doc, Fox News has nothing to do with it other than hosting the link. You're spinning information worse than Fox ever could. Here, does this make you feel better? http://www.defenselink.mil/news/ISN10013.pdf

Now, how about the confessions before and after, and how about addressing the document, or more lame dodging and excuses?

JMH423- will you be defending KSM's innocence at the steps of the US Court House downtown?
