Dave Herman retired disc jockey arrested

For those expressing skepticism about this one, you can view the original complaint on the Dept. of Justice webpage HERE. (WARNING: Definitely NSFW.)

I used to be a criminal defense attorney. Trust me when I say that he's not walking on this one. He couldn't have done worse for himself if he had personally called up the FBI and asked if they had any young girls available for sex tourism that night. The prosecutor would have to work very hard to lose a case with as much documentary and physical evidence as they have.

It's over for this guy. He's cooked, carved, and served. At this point all he can hope for is that his prison assignment is in a warm climate.
Page 1 is there but 2-4 remain blank???

May be my problem? Did it load ok for others?

Talking about him crossing it off his bucket list is to me a very callous and simplistic reaction, based on emotion not reason. But so what, right? If the cops say he did it that should be good enough. Like someone wrote, screw him.

But isn't this exactly how humans act? I see no need to impute other than basic drives and simple, unreasoned impulse.

The whole thing is entrapment. There WAS no six-year-old girl. The police officer in the chat room made that up.

I read of a similar case in my area. A guy was chatting with an police officer he thought was a fifteen-year-old girl. They made arrangements to go to a motel. When they guy showed up he was arrested.

His lawyer wanted to fight it. His lawyer wanted to argue, "It's the Internet." What reasonable expectation did he have to believe the person he was chatting with really was fifteen years old? It's the Internet. Everybody lies about who they are.

The lawyer said his client, who had never been arrested before, was too traumatized by the publicity the case got to want to prolong it. He was offered a plea deal and he took it. The lawyer said he felt these chat room stings raise a lot of questionable issues. That in some ways the state's conduct is more troubling than the individual's. He said he had represented several individuals arrested in these stings. The arrests always get a lot of publicity. None of the clients ever want to fight.

I agreed. It is troubling.

I just don't get your logic. Based on all available information, he was going to have sex with a fifteen year old girl. Do you really think that if an actual fifteen year old girl showed up he would have said " sorry thought you were lying, have a nice night".

If you do believe that i have a few bridges you might be interested in buying.

What do you do now?

Anyway. It is obvious he is cooked. I'm just not sure if it makes a lot of sense for society to spend so much money on him to put him on trial and then spend sooo much money taking care if him for the rest of his life. Make a deal right now and give him 20 years house arrest.

I mean.... The Dodgers fans that nearly beat a man to death only got 12 years between the 2 of them... This guy just wanted to molest an imaginary girl....

He wanted to molest a real girl, she just didn't materialize.

Yeah... you're right.... I just find it weird. My buddy's dad got like 4 months for molesting his 1 year old grand daughter.... He actually did it. This guy was just trying to. That will probably land him in prison for the rest of his life. Different countries I guess.

The system isn't perfect, but we can't let bad examples set precedents. To this guy there was a seven year old and said seven year old was going to be a sex toy. Barring a legitimate insanity defense, nail him to the wall, metaphorically of course.

I'm not defending sex offenders... but the guy is 77 years old and he is already completely destroyed. It's a sheer fortune to prosecute and house this guy.... I just think the money can be better spent elsewhere in the justice system.

I like certain parts of the US justice system. Here in Canada we'll see murders out of jail in 10 years..... or brutal murders out in 20.... people that should never see the light of day again... I do like the fact that the US just locks those people up and throw away the key..... But on the other hand in the US, you see people behind bars for 10 years for some pretty weird things..... like theft... or certain drug possessions. I think that gets pretty expensive, I'm not sure you can keep it up.... And that's kind of my point. This guy is already completely destroyed... there is no victim,,, so why not just give him house arrest and let him die?

I can't believe how many people in this thread are defending someone who was planning on raping a 7 year old.

“Age 6 is the perfect time to start being loved that way,” wrote Herman in one message. In subsequent chats, Herman suggested that he may have to give “Lexi” alcohol in order to relax her.

Sounds like something he may have done in the past too by the sound of it.

He has many fans in the New York area and I'm one of them. "Good just barely morning." That was Dave.
I was a fan too. So what?

He's seventy-seven years old. What was the point? I think he needs to see a doctor.
He went to St Croix for the opportunity to give a 7 year old girl a stuffed animal and then rape her. That's the point.

The idea that the police go in these chatrooms and orchestrate something like this with a 77-year-old man, then arrest him, is troubling.

His age has nothing to do with it. If there is sufficient evidence that he has severe dementia or psychosis and somehow didn't realize he was doing anything wrong, then fine, let him plead insanity and get treated. But that would be true regardless of his age.

Is there any evidence he ever had sex with a child?

Perhaps nothing conclusive, but he seems to hint that he has. More may come out on that question. Anyway, he was clearly willing to and actively planning on it.

I think he should get probation. What I read he said was awful.... He's a pretty sick dude..... That's an awful lot of money to spend on a guy that most likely will be dead in a few years.... Even house arrest or something... My guess is that the stress of this event will cause his health to fail hard in the next few years.

So? It would be even more expensive if he wasn't going to die soon. And plenty of people live into their 90s. I don't see any point in giving someone special treatment for being old.

He initiated the chats according to the story I read.

See, I don't view that as similar. While talking a 15 year old into having sex with you is bad, talking a woman into letting you rape her 7 year old daughter is about 100 times worse.

I do. Being practical... saving $$$.

DId WW2 teach you nothing ? It taught me there is no such a things that a normal person will not agree to.

What would the police need to say in an internet chat room in order to persuade you to agree to isolate and rape a 7 year old female?

It would save money if he was young too. Your argument makes no sense.

If the state wants to save money on incarcerations, fine. The logical place to start is drug offenders, not child rapists (or people conspiring to become child rapists).
