Continuation Part 10: Amanda Knox/Raffaele Sollecito

In looking for the declarations I found this:

MASSIE’S MISLEADING REPORT,
Misleading statements about what time Meredith UK phone was found and delivered to the Postal Police Post on Nov 2 2007.

CELL PHONE EVIDENCE, MASSEI REPORT:
SUMMARY: This excerpt from Massei's report is a perfect example of cherry picking and attempting to conceal the truth by intentionally confusing the issues by scattering the pertinent information helter skelter throughout the report. If you will read this closely, and read my notes you will see that Elisabetta Lana's daughter, Elisabetta Biscarini, found Meredith's UK phone at 12:07 pm and not between 11:45 am and 12:00 noon, as Massei's word smithing would lead one to believe. Also you will see that Mrs Lana did not deliver the UK phone (2nd phone found) until 12:46 pm (which is in agreement with the postal police post logbook entry, the altered logbook Judge Micheli said he did not see, and apparently did not want to see ) and not around 12:15-12:20 pm as Massei’s word smithing attempts to lead the less attentive to believe .

I don't see that this is so fundamentally different from Amanda's alibi. Mignini managed to fit the circumstances of the murder around A & R's alibis, even though it forced him to make the time of death and their journeys to and from the cottage totally implausible.

Had he gone after Filomena I'm sure he could have found a willing tramp and a woman to hear an impossible scream at whatever time suited him.

Hi Lonepinealex,
I think it odd how The Flying Squad could not apparently find and interview any of the guys whom Rudy Guede says were playing basketball that night when he left Miss Kercher to die and walked past the court.

Weird too is that the tramp did not see Rudy Guede either.

From Rudy Guede's Germen Prison Diary,
written before PM Mignini had a chance to interview him:
I left the house in shock. I was outside, but didn’t know
where to go, seeing still all that blood. It was all so red. I
thought of going home. I had wet trousers and tried to
cover it with the sweatshirt. There were a lot of people in
the street, in Piazza Grimana. There were some guys still
playing basketball even though it was dark.

A & R only had themselves as alibis from about 8:45 until noon the next day.

F had two others and I think they were in public at some time and they were much farther away necessitating driving not a 5 minute walk but if wish to see the two sets of alibis as the same, fine.

Btw, the original TOD was earlier and only moved to fit the super witnesses.

There was the Naruto download as well.

Of course it's more complicated to destroy Filomena's alibi, but most people wouldn't consider Amanda's alibi weak in the first place - that's why Raff had to be dragged into it. Mignini could have cobbled something together I'm sure. Russ Faria's prosecutor did, despite him having four alibis, CCTV and receipt evidence in his favour.

Look at Patrick - he was in his bar most of the night and it was obviously a massive wrench for them to finally admit defeat on his alibi and let him go.

Point is, both Filomena and Knox HAD essentially the same alibi as of what the cops were hearing on the afternoon of Nov 2, 2007.

Even at that time three people supported Filomena's alibi.

But on Nov 2, what was the reason to so quickly narrow in on Knox and exclude Filomena?

Beyond the weaker alibi, Knox was the first known person to visit the cottage after the murder and she came up with quite an absurd story of what she was doing there.

Simply because he did not go that way. It's a lie, as many other things in Rudy's tale.

Exactly. The point is, as stated above, is that whoever it was Mignini tried to pin it on he was going to un-do their alibi somehow. In Amanda's case, he arrested her alibi.

Why wouldn't he have simply arrested Filomena and ALL of her friends? It simply would have made for a larger Satanic rite with more participants....

Mignini did not neglect to drag Filomena into an all-night interrogation because he was soberly and methodically analyzing alibis.

With the Narducci case, Mignini showed himself more than adept at filling in holes rhetorically.... why not here? How many did he arrest in the MoF case?

There was the Naruto download as well.

There was no talk about any download. It was already in the computer.
Only a claim of a record in the Spotlight log of starting Naruto. Hellmann did not allow discussing it in the appeal. Nothing is known if it was indeed watched at all.
Anyway, neither of them claims to have watched anything after Amélie.

Even at that time three people supported Filomena's alibi.
So four arrests! For heavens sake, they weren't shy about arresting Lumumba or Sollecito!!!!

Beyond the weaker alibi, Knox was the first known person to visit the cottage after the murder and she came up with quite an absurd story of what she was doing there.

Obviously Knox should have been investigated. All keyholders should have been, and obviously the PLE would have been even more incompetent to not check out Knox's story.

She also did more than what you say above - she slowly started contacting people drawing attention to the cottage which is not what perps do. Perps do what Rudy did, get as far away as fast as possible.

An osmotic assessment of Knox clears her IMO. Having to arrest Raffaele too shows the reach they were making. The real problem since (amongst many) is that an equal case needs to be made against him now.

It is a stand-alone question Raffaele asks: a question even apart from the questions Amanda could similarly ask. Raffaele can say, "What's any of this got to do with me?"

Even though it is separate from Amanda, if one answers, "nothing - it's got nothing to do with you," then bazinga..... Amanda has an alibi.

It is curious that the only Italian who didn’t get a lawyer was Raffaele, despite his sister being a Caribinieri officer at the time.

It's more than curious, it is positively stupid. Read Sollecito's book on his own assessment of this point.

Oh wait, you can't. His book is banned in the UK.

Simply because he did not go that way. It's a lie, as many other things in Rudy's tale.

As far as I know, the only evidence that Rudy didn't take the route through town and up the steps as he claimed is a construction accounting for why Meredith's English phone wasn't turned off. I have the alternate paths on the map on the bottom of the page at http://murderofmeredithkercher.com/ (click on the map to see the in-town route). I should note that an alternate in-town route would have Rudy avoiding the prominent 360° CCTV camera by going up the steps on the othe side of the basket ball court, around the back of the University for Foreigners to the narrow steps between the buildings that leads to his street. But that route also takes him past a CCTV camera that was on the restaurant behind the school.

Hi Bolint,
How do you know it's a lie?
Did the cops find a bloody trail leading somewhere?
Did someone see Rudy Guede walking a different route?

Do you have any proof,
or is this just your opinion?

Oh wait,
you Bolint, believe the tramp, right?
And Antonio never mentioned these people around Piazza Grimana nor others playing basketball that night, right?

I wonder if "Toto" mentioned this to the police when they talked with him
the day that Meredith was found murdered.

Question:
What benefit would it be to Rudy to lie and say that people were out and about,
unless he figured that they saw him too?

Rudy Guede said:

playing basketball even though it was dark.

In my opinion,
we who discuss this case in detail can not rule out that Rudy did indeed walk by the basketball court after he left Meredith die, walking away, covered in her blood.

I also find it weird how the tramp did not even mention seeing a guy+girl, (Raff+Amanda) hanging around outside for hours arguing when he talked to the cops that next day.

The tramp had already been a witness in 2 previous murder trials,
surely he would understand the significance of a couple arguing for hours and looking towards the direction of the flat where a young woman was found raped and murdered.
Why did he not tell the cops this that day?

I wonder when the guy+girl that The Tramp saw
both had time to join Rudy to rape and murder Meredith?

Wonder what was Rudy doing
while Antonio Curatolo states that he saw Raff+Amanda outside at 9:27pm and onward?
Curatolo never makes mention of him.

Was Rudy having a drink with Meredith while on a date? Cooking for her? Listening to his rap music while defacating in Meredith's landlords bathroom? And what about Meredith? What was she doing then to? Slipping into something more comfy for a date while her boyfriend was outta town? Playing with her phone, even texting? Studying and taking notes while using the book she had just borrowed from her English gal pal?
Just wonderin'...

PS-Hi Dan O.
Thanks for the link above,
I'll have a look...

A question, folks:
What is your opinion of Meredith's bedroom?
Was there a light on?
Her own or Amanda's?

From Rudy's German Prison Diary:
Rudy Guede said:
the house was not well lit.
Only Meredith’s room had light.
I remember because the abat-jour was switched on.

I strongly believe that Rudy took the alternate path. That he avoided any chance for others to see him in the light. That he took the path down through the valley and doubled back and attempted to get through the door of the walls just a few feet from his house but they were already closed and then he went around to the other entrance and threw Meredith's phone away into Lana's garden.

What did he write? I have never really understood the family dynamics that lead to Raffaele ignoring the advice of his father and Caribinieri sister and repeatedly returning to the police station without legal representation.

That is an important point. . . . .All the people at a party make an alibi for her but not all the people in the club for Patrick.

Even at that time three people supported Filomena's alibi.

They eventually tried to drag eight people into the rape and murder of Michelle Moore-Bosko with the Norfolk Four.

Guess what, just like this case, one person actually did it.

Hi Bolint,
How do you know it's a lie?

Of course I dont' "know" if it is a lie.
But I don't believe that he went out at the gates into the streetlight in a clear area in bloody clothes. No way.

you Bolint, believe the tramp, right?
In my view he is not reliable. Nor is he refuted, though.

One objectively sure thing is that on Nov 2 at about 15:00 Curatolo was sitting there reading some magazins as documented by a tourist student girl walking that quarter:

while the crime inspection was going on at the cottage:

Because they were not there, I think.

Question:
What benefit would it be to Rudy to lie and say that people were out and about, unless he figured that they saw him too?

Simply adding some small detail to make a lie more credible.
He could not say "I am innocent, but I still went through the ravine ..." or some other way.

What did he write? I have never really understood the family dynamics that lead to Raffaele ignoring the advice of his father and Caribinieri sister and repeatedly returning to the police station without legal representation.

He simply did not take seriously the idea that he could be a suspect. It was on its face absurd, and so, like a lot of young people, he just ignored family members telling him how to behave. Most innocent people who've never looked closely at how murder cases can go wrong would do exactly the same thing.

I don't think his father and sister took it all that seriously either, to be honest. Do you think for one second that if his father had believed R was in danger, he wouldn't have hustled up to Perugia and taken over during those first few days? Based on his behavior in the years since the arrest, I'm pretty sure he thought that R was safe from crazy prosecutors.
