I could be wrong, but isn't hiring an illegal alien only a finable offense? I have not heard of people being arrested for hiring illegal aliens before. I admit lacking knowledge of the criminal penalties spelled out in that federal law. I will see if I can find them.

It appears there is only criminal imprisonment for a pattern or practice. It appears this is not the sort of issue that calls for a criminal arrest during investigation. That is likely why she has not been arrested.

Also, if there is strong evidence (I am not judging either way) the Department of Justice might wait until after the election to avoid appearing to interfere in election politics.

Whitman should be fined, the employment agency should be investigated and criminal charges filed if warranted.

Maybe it is in some form of deliberation? One can fight and appeal a deportation order and even remain out of custody while doing so. It can also heavily depend on if she entered the country illegally, or entered legally and overstayed her permissable time period. Also, the general policy of US immigration is to focus first on aliens that have committed other crimes. She may be low a priority.

I expect without knowing any relevant facts that is a matter of her fighting her status in the legal system in combination with being a low priority type of case.

My guess is because she's a witness in an ongoing criminal investigation. In which case Whitman is praying for a speedy deportation.

For what? Hiring an illegal immigrant? I don't think you can get fined for that. You can get fined for hiring someone you KNOW is illegal, or for not doing the proper paperwork, but if you've done the proper paperwork in good faith (meaing someone else committed fraud, as we know Nicky Diaz did), I don't think you have any liability.

Did you read the story? The Social Security Admin. informed her in 2003 that the SS# for her was bogus. It's hard to say she was acting in good faith after that.

In some cases, maybe, in others, maybe not. Depends on the situation, I suppose.
How about submitting a false SS# and green card in order to work in the US illegally?
 
Gee, let's look at the facts here …

- In 1999, the maid lied to the employment agency about being an American citizen, submitting false ID to do it and signing forms under threat of perjury.

- In 2000, Whitman hired the maid from the employment agency, assuming that person would be legal. She paid the required state and federal taxes.

- Whitman wasn't trying to get maid service for nothing, like you would if you wished to abuse an illegal immigrant. She paid the agency $23/hour for the service.

- In 2009, the maid came forward and told Whitman she was an illegal. A week later, Whitman fired her. She had no choice because that's the law. She was under no obligation to report her, however, and didn't. This was, after all, someone who in 9 years had become a part of the family. I'm sure she felt terrible.

- Whitman (or at least her husband) apparently received a letter in 2003 sent out by the government warning them of a social security number mismatch with regards to their maid. The letter said nothing about the employee being possibly illegal. In fact, it stated "this letter makes no statement about your employee's immigration status" and warned the employer that it was against the law to use the letter "to take any adverse action against the employee, such as laying off, suspending, firing, or discriminating against the individual". Nor did the letter specify any action to be taken by the employer other than asking forms be completed and returned. There was no law broken in the way that Whitman and her husband responded. Whitman's husband simply wrote a note on the letter and gave it to the maid telling her to take care of it, whatever the problem was. They did what seems quite reasonable. End of story.

- Except here we are, just weeks before a very tight election between Whitman and democrat candidate Jerry Brown, when the maid turns up beside leftist Gloria Allred, weeping about having lost her job and saying it was unfair, with Gloria threatening to sue on her behalf.

Now let's complete the rest of the story.

- Gloria Allred is a highly partisan democrat who has contributed tens of thousands of dollars exclusively to democrat candidates over the years and who has a history of smear campaigns like this right before elections. She tried it against Arnold but it didn't work. After that election, the lawsuit she'd filed against Arnold on behalf of her *client* was thrown out of court. In other words, it was without merit.

- And representing clients whose cases have no merit is not a new thing for Gloria. She is well known in the area as a lawyer who files many cases simply because she knows most of them will be settled out of court to avoid the cost of defending against them. Some would call her a successful bottom feeder.

- Gloria Allred has a long association with Brown and has donated money to his past campaigns. She donated $1000 in 1982 and donated more since. She's also donated time to his campaigns. She's admitted to knowing Brown personally and there are various pictures of them together.

- It is very clear from the ads that came out immediately after Allred went public, that the Brown campaign had a heads up this was going to happen. KTVU news director Ed Chapuis, of KTVU-2 in San Francisco, said a Brown campaign aid told it's political reporter two weeks ago to watch for developments related to a Whitman housekeeper. That Brown allowed this to proceed is despicable.

And the real tragedy is that the one person Whitman tried to help by not handing her over to ICE when she admitted to being an illegal, will now probably be facing deportation. Thanks to Gloria Allred and Jerry Brown.

No it didn't. Perhaps instead of reading the story, you should read the actual letter:

The SSA letter indicated that there was a discrepancy. It did NOT indicate that the SSN was bogus. Note one of the listed possible causes: name change. What do we find on page 2? A name change. And that isn't the only possible benign cause for receiving such a letter either, as the letter itself makes clear.

Edit: note also that the letter specifically states it does not indicate anything about her immigration status, AND that the letter should not be used to take action against her.

It's hard to say she was acting in good faith after that.

That's just not true. The letter shows nothing of the sort.

pass a law mandating 1 year in prison for knowingly hiring an illegal alien, and we will see a very sudden and acute slow down of illegal immigrant flow to the USA...and a sudden back-flow of aliens to Mexico and elsewhere.

"how then will we clean our houses, care for our children, and harvest our crops", you ask?

through legal temporary worker visas and legal house-cleaning, childcare agencies.



Illegal immigration is a two-way street. They won't come if we won't hire them.

As a free market purist, I don't believe the government has any damned business deciding who can work for whom.

When I needed help with my yard I hired a Spanish speaking guy, he needed money, I needed help. I don't give a damn if he's 'legal'
