Thats an astute observation - latin tends to lend the most prosaic of phrases 'gravitas' (I'm getting good at this :)).

I'd also suggest that roman maxims are pithy & easily understandable. The average Freeman lacks the intellect & patience to get to grips with statutory interpretation or plough through mounds of case law. Far easier to shock and amaze your gullible audience by throwing a legal fossil into the ring.


You'll find it in other fields, for example fossilised medicine. Homoeopaths like to translate the names of their remedies into cod latin (e.g. "Excrementum Can." - well, I suppose there might be other issues involved in labelling that one in English).

If the FOTLers used a quantum mechanic they could get out of speeding tickets by arguing that the prosecution could prove where the car was or how fast it was going, but not both.

I havent done a NOUI&COR yet... but I think in the tradition of being honourable, I'm in the process of giving the government the opportunity to show me what claim of authority they have over me.

When they show me that they don't have such a claim I reckon I will sort out my NOUI&COR and get on with the walking of the walk.

I'm basically building my confidence right now. The whole philiosphy makes perfect sense to me. I prefer to give them a chance to show me their true colours before there is any controversy.

Sorting out my final reply to the Ministry of Justice, then I think they've got a month to answer (under their rules, not mine) and assuming they can't show me a legitimate claim of right to tell me what to do (which of course they can't) then through the bubble I go.

I do get the idea of legal latin as a useful shorthand, but I cannot help thinking of the "A fish in your pocket" from the dish-world. :D

I'd prefer to invoke Acquiris Quodcumquae Rapis or Quia Ego Sic Dico
 
But even better, when he/she gets time in Prison to make little ones out of big ones (the reverse of their current policy), the FMOTL's can still win by quoting Latin in all it's beauty, and getting a moral victory

In the English criminal courts a lot of legal Latin still hangs around again because it's a handy shorthand : prima-facie; res gestae; res ipsae; mala-fides are all ones I've used within the last couple of weeks.
Even the odd bit of Norman French (lovely fellow Norman) - voir dire for instance.

Some Norman French is also used in the American Legal System. For instance the Sessions of the Surpreme Court are opened by a Baliff saying "Oyez,Oyez,Oyez".

This person seems to think that the FOI act entitles her to send in all manner of kooky opinions and questions and have them answered, within a deadline from the original request. The actual law ('scuse me, guv'ner, you probably meant "act") will freeze and "restart" the deadline if clarification is needed, and has a couple of other practical limitations. These details seem to past right over the poster's head, despite being stated repeatedly.
