For a start:
He's talking about a strict liability offence here. Mens rea doesn't come into it.
Ah, but mens rea is rooted in common law, so by their lights, it has to be present - because they are only under common law jurisdiction. They don't recognize strict liability - unlawful, you see?
Except mens rea comes from the actual, real common law tradition, not the made-up FOTL version.
It's all such a jumbled mess.
