If this order is given any effect, yes. There is no federal murder statute, but the U.S. President has zero authority to bind state courts to a particular sentence or to preclude clemency for state offenses. On any federal charge, the President has zero authority to mandate a sentence upon conviction. He can decline to pardon anyone convicted of a federal offense, but he cannot bar any future President from doing so.
That said, there should be no clemency. The person who shot Kirk is guilty of first degree murder and should be punished accordingly.
