Merged Due process in the US

Stephen Miller is the most dangerous person in the Trump administration. He is a true believer in white nationalism. And unlike Donald Trump, he is sharp enough on his feet to seem like he knows what he's talking about. Fun fact: Stephen Miller does not have a law degree.

ALso, Noem knows the answer and is just spouting propoganda and lies to avoid the question. It's the same as "what is due process?", "it's Trump deporting immigrans."

Nor do I. Although I have a fair amount of understanding of law, I defer to lawyers over non-lawyers on the proper meaning of laws.

Indeed, which led to Ex parte Milligan (71 U.S. 2 [1866]) which is a landmark case narrowing and clarifying many things having to do with Presidential authority in wartime, including how and when habeas corpus may be suspended. Milligan also clarified that while habeas proceedings may be temporarily suspended in times of war, due process still applies to those detained.

Today I was accused of racism because he's not the best poster boy for fighting for migrant rights, specifically regarding Due Process and the Alien Enemies Act.

Specifically, I was accused of not supporting him because of his "skin color".

Funny thing is, he and I share the exact same skin color.

For some reason, charges for trespassing against the Newark mayor were dropped. This, the same day the Trump Regime decided to charge a congress woman with assault, which will likely be dismissed or dropped as well.
 
Maga-chud (ess?) moves to expel McIver.

Rep. Nancy Mace (R-S.C.) said Wednesday she is filing a resolution to expel Rep. LaMonica McIver (D-N.J.) from Congress after the Justice Department charged her with allegedly assaulting law enforcement.

Why it matters: The resolution is a long shot — and Mace isn't yet forcing a vote on it — but Republicans seem intent on punishing McIver and two other House Democrats who were involved in a scuffle with ICE officers.

  • The three-page measure says McIver "must be held accountable to the highest standards of conduct in order to safeguard the public's faith in this institution."
  • McIver, who has denied assaulting law enforcement, responded in a post on X: "In the South I think they say, 'bless her heart.'"

The reason given was that DHS wanted to "move forward" from the issue. That's prosecutor code for an admission that they don't have enough evidence to convict. Interim U.S. Attorney for New Jersey Alina Habba (in strong contention for the worst lawyer in the President's circle) personally argued at the arraignment, which is quite irregular. Normally this would have been argued by someone with criminal trial experience. What likely happened is that the rank-and-file AUSAs eventually convinced Habba there was no way they could win the case.

In addition, DHS invited Mayor Bakar for a tour of Delaney Hall, as he originally requested. This sudden change of heart could be an olive branch to the mayor in hopes that he doesn't try to go after DHS for wrongful arrest.

Member of Congress LaMonica McIver (D-NJ) has been charged with assaulting a federal officer. There is video that appears to show Rep. McIver shoving a uniformed officer. She maintains she was being pushed from behind.
 
i just don’t think the prosecution has the necessary credibility to move forward with this kind of charge
