The ICE agent stated his belief that members of Congress could not be refused entry, which is a reasonable interpretation of the law and comports with published ICE policy. That does not preclude other sources of statutory that allow other officers to enter on official business. ICE agents are not necessarily experts in that regard. In fact, the presumption of regularity requires deference to a mayor's belief for what his authority includes.

The agent opened the gate from the public area to the guarded area and let the entire party in, after which they had a conversation over who would be admitted to the building and who would not. At the end of the conversation the mayor was warned that he was liable to arrest if he continued to stay, so he left. If you are invited in, you are not trespassing.
I see no evidence they invited the mayor in.

Please provide it.

No, I really didn't. The city's allegation is that the building is not properly permitted. The building owner's claim is that they possess the proper permits. It is within the city's right to inspect such permits as the owner claims he can produce, and to enter the property to confirm that the permits are for the purposes alleged.

I'll be the authority on what my argument is, if you don't mind.

I am not a lawyer. My spouse is a public defender. I'm part owner of the bar nearest the law school, so I have many conversations with lawyers, law professors, and law students on current events and other topics of law. I have participated in a number of court cases in the roles of plaintiff, defendant, lay witness, and expert witness.

I might, but at least she has a license to practice. I should add that I got a passing score (73%) on the practice bar exam, but obviously that doesn't qualify me to do anything except wear a white wig and debate pointlessly on obscure web forums.
 
I asked because it seems one person is talking about how the law works and the other seems to make claims based on how they believe the law should work.
My understanding of how the law works is my best effort as a lay person who has been privileged to associate with practicing attorneys who will answer questions for me and engage in debate and discussion over High West Double Rye, and occasionally advocate for me in court.

Mayor of Newark is not a construction or permits inspector. HE has no authority to just walk on to the property, nor is he trained to do such a thing.

Was he wearing any required PPE to engage in such an inspection? Hard hat? Steel toe boots? Retroreflective vest? Sure dont look like it.

The video I posted was edited. We dont see how many times the Mayor was told to leave or be arrested. If he was told to leave once, and refused, he was trespassing. And can face arrest. The Mayor of Newark is not above the law even if his intentions are good.
If he's the mayor I suspect his authority goes beyond that of his employees. Just guessing here. What does PPE have to do with anything? Obviously nobody working there had it. Do they issue PPE and hard hats and stuff to the detainees? I've had a number of instances of permit and construction inspectors visiting my place of work or residence. Never once did they have to wear protective gear, any more than I, or the people working in the place, did.

And finally, though this is obviously an issue that will be debated, if the order to get out was illegal, as many claim it was, then obviously the number of times the order was given, or the violence with which it was implemented, is not an argument. An illegal order is not made legal by repetition, and certainly not by force. You may be right that he was trespassing, though I seriously doubt it. But if he was not, then the rest of your argument fails.

You shouldn't have attacked that guy who was obeying the law. But judge, I told him to stop five times, and he kept refusing. Still not enough. But judge, then I shot him. Still not enough. But I shot him ten times! Oh, then it's his fault.

The mayor of Newark has appeared for his arraignment and has pled not guilty. It is hoped his trial will be expedited to occur this summer. And if Alina Habba is handling the trial practice herself, it should make for some cracking legaltainment.

Yes, just as Trump is the chief executive. Doesn't mean he can walk around the local federal construction site and do an inspection.

Yes, and they send an inspector to do that, with the right qualifications, training and necessary OSHA required PPE. Not the ◊◊◊◊◊◊◊ mayor who is engaged in a publicity stunt cuz he's running for Governor.
