The tweet suggests the entire court ruled on this. No, Alito alone did. If Alito thinks the case has merit, he can accept the appeal, but even then, the full court doesn't need to hear it. He must be joined by two other justices. He basically cut it off at the knees. Which is what I expected.

You are right techincally, but still pretty much clear the Supreme Court is not going to touch any of these lawsuits with a ten foot pole.

Wouldn't it be three? Don't you need 4 justices to bring it to the full court?That's how they do it. Alito has general authority over appeals in the third circuit. He denied referral to the full court. And even if he referred to the full court (IIRC) he needs two other justices to accept it.

At what point do they realize that this means nothing? In a week? In two? Basically being "docketed" means we stamped your fax "received" and filed it.
Apparently, this goes a lot deeper than we thought. Even the conservatives on the SCOTUS are in on the fix, too. Along with various state Supreme courts, federal appeals judges, pizza shops, the Post Office, and more.Also you have to wonder why. The Texas suit makes the exact same argument that Mike Kelly's Pennsylvania suit made that Alito just tossed.

I just can't conceive of Dobbs having any genuine difference with Miller. It occurs to me maybe he is attacking some unnamed other Republicans. Bill Barr?
