Trump runs for POTUS/ Trumped Up! Part VI

He loves to threaten and not follow through. He threatened Ted Cruz and The Right to Rise PAC already this election with lawsuits.

Didn't John Oliver point out all the times Trump used the threat of lawsuit to intimidate enemies without ever following through?

He doesn't have the stamina to take on the Times.

That doesn't matter. You sue anyway according to his mentor. In the aftermath of the housing discrimination "settlement" (as Donald reminds us - "never admitted to anything") he had his mentor, Roy Swampscum Cohn file a counter suit straight out of the Orly Taitz School of Crazy.

Cohn's the originator of the accuse, counter-accuse, sue, never apologize school of business.

They'll say " BRING IT ON DONALD" and double down on ripping him to shreds. There is an old maxim about picking a fight with a major newspaper. "Never pick a fight with someone who buys ink by the barrel."
Trump's been on that course from day one, deliberately making the press a target for his baying acolytes. This is not a man of sound mind. (Barely a man at all, but that's another matter.)

On what grounds will he sue? They have reported the claims of two women. The Times isn't libeling him. If anyone is, it is the women.

And given he is a celebrity, good luck in going after them

Fair enough, it's been rape in all 50 States since 1993. The alleged rape took place on December 4th 1989 in New York. I'm checking.

1984.

In the 1984 New York Court of Appeals case of People v. Liberta, judge Sol Wachtler stated that "a marriage license should not be viewed as a license for a husband to forcibly rape his wife with impunity. A married woman has the same right to control her own body as does an unmarried woman".

That is disturbingly recent.

This would presumably be about his tax return which they published.

I heard that might be illegal.

Yeah, here:

https://www.washingtonpost.com/news...-trouble-to-publish-donald-trumps-tax-return/

Federal law makes it illegal to publish an unauthorized tax return or "return information":

It shall be unlawful for any person to whom any return or return information (as defined in section 6103(b)) is disclosed in a manner unauthorized by this title thereafter willfully to print or publish in any manner not provided by law any such return or return information. Any violation of this paragraph shall be a felony punishable by a fine in any amount not exceeding $5,000, or imprisonment of not more than 5 years, or both, together with the costs of prosecution.

There is a First Amendment defense, but it isn't a sure winner.

And a candidate for President. NY Times v Sullivan provides an even higher bar for public figures than "absence of malice". Under most circumstances he'd have to prove not only that the Times was reckless but published the story "with malice" or knew the story was false. And the fact that he is both a celebrity and a public figure makes even that not good enough.

Good luck Donald.

There are state laws too, read the whole story.
State laws against people who work for the state divulging the info.

For example, New York (comes straight from link in the article)

e) Secrecy requirement and penalties for violation.--(1) Except in accordance with proper judicial order or as otherwise provided by law, it shall be unlawful for the commissioner, any officer or employee of the department, any person engaged or retained by such department on an independent contract basis, any depositary to which any return may be delivered as provided in subsection (h) or (i) of this section, any officer or employee of such depositary, or any person who, pursuant to this section, is permitted to inspect any report or return or to whom a copy, an abstract or a portion of any report or return is furnished, or to whom any information contained in any report or return is furnished, to divulge or make known in any manner the amount of income or any particulars set forth or disclosed in any report or return required under this article, undersection one hundred seventy-one-a*or*section one hundred seventy-one-h*of this chapter, or under this article and article eighteen of the labor law.

Yeah, people are talking about discovery, but I can't see this getting that far. This case fails on principle, irrespective of facts.

The suit comes into court, the Times says, "No," and the judge says, "Case dismissed"

Maybe not. Seems to be over the story about women accusing him of groping them.

This Story (per Robert Costa on Twitter)

I assumed it would be over the tax return because there is a pretty clear legal basis for that one.

ETA: just reading that story now. Gotta quote the bit where they called Trump for comment:
In a phone interview on Tuesday night, a highly agitated Mr. Trump denied every one of the women’s claims.

“None of this ever took place,” said Mr. Trump, who began shouting at the Times reporter who was questioning him. He said that The Times was making up the allegations to hurt him and that he would sue the news organization if it reported them.

“You are a disgusting human being,” he told the reporter as she questioned him about the women’s claims.

Asked whether he had ever done any of the kissing or groping that he had described on the recording, Mr. Trump was once again insistent: “I don’t do it. I don’t do it. It was locker room talk.”
