Well certainly not Mignini, in his new role he no longer tries cases or leads investigations. Maybe Commodi, but wouldn't that be a conflict of interest?

But I don't see Rudy being entitled to another trial no matter what. (for reasons LJ outlined in a post a bit upthread.)

Its an odd situation where Kerchers want Rudy Guede to speak but ....

their lawyer Maresca discouraged it in court, and now Rudys lawyers are also going to great lengths for anything Rudy says to be stricken and silenced, per media, and for an almost protective isolation of Rudy to not have visitors by even Govt officials.

Even the PGP sites, who claim to support the Kerchers, at least in words (maybe not so in action), have seemed to protect Rudy Guede and have little interest in applying their efforts to his case and possible lone wolf crime and seemed to attack anyone who questioned that Rudy Guede was the "main evil" as Massei called him.

I agree with others, if there were "deals" made by Migninni and in presence of Matteini then Rudy presents a serious issue in this case. Imagine the financial lawsuits that would come! maybe exceeding imaginable costs, in damages, far more than the tens of thousands Migninni spent on the cartoon/video.

This financial damage to the Italian system has to be placed back at Migninnis feet, he presented it. Frank Sfarzo mentions he told Migninni not to listen to the Perugia "pack", but still it was Migninni's job to be able to run a case, including accepting or rejecting evidence presented.

It wont be headlines, it took many years for the Central Park Five to get their 10;s of Millions, but it seems obvious Raffaele, especially, will be awarded a huge huge payout for Migninni's mess.

I'm actually betting on Alfred Brizzioli (?), Raf's lawyer in the trial over "Honor Bound" pressed by MIgnini.

Mignini charged Brizzioli as the Narducci's friend and lawyer in the cae against 20 people from Florence. Everyone else rode it out for 4 years, finally accepting the victory based on a lapse in the statute of limitations (after the courts had first established their was no criminal conspiracy - read satanic/masonic sect activity). Except Brizzioli.

Brizzioli insisted on a final verdict to clear his name.

My guess is even if Mignini offered to drop the case at this point, Brizziloi and Raf won't accept it. They want to beat Mignini in a court room, and Brizzioli has waited over a decade, and Raf nearly a decade, to get the chance.

I would expect cassation's motivation report over the recent acquittals to play a significant role in the hearings. All those judicial findings will be hard for Mignini to dance around, I'm guessing.

As for Rudy talking, I think a lot depends on Mignini. One thing though, Rudy always talks when and how he thinks it will benefit him. The only bargaining chip he has left, without further implicating himself, is if Mignini encouraged him to include Amanda and Raf in his story. And Rudy's case is still sealed. Mignini interrogation of Dec 7, 2007 will be a fascinating read at some point.

Rudy seems too young to go the way of Curatolo. I think there's more drama yet to unfold in this fiasco.
 
Regarding Guede's case being sealed, can the courts keep it sealed forever or does it have to be unsealed eventually?

Los Angelas has settled a lawsuit by agreeing to pay $8 million to a man who spent 17 years in prison for a murder he did not commit. While investigating the crime Los Angelas police found shell casings which they failed to report and test as evidence.

The wrongfully-convicted man still has a separate lawsuit pending against the prosecutors who concealed an agreement they made to provide leniency to a pimp who testified for the prosecution.

The only data that I recall is Biscotti saying

"Rudy did not name anyone because there is no one to name"

This was at a time he must expect the others to be released.
He could have no real world expectation that uninvolved people in his crime would remain securely locked up by the morons.

Some of them are still "arguing" that Knox and Sollecito do not stand innocent in relation to the murder charges, merely that they've been found not-guilty. In these idiots' pro-guilt commentators' minds, there's a clear difference. They back up their "argument" by stating that courts do not make findings of "innocence", merely "non-guilt".

Maybe they would do themselves a few favours if they stopped to think about this for a moment (and preferably without the veil of bitter vindictiveness drawn down over their eyes). In Italian law - just as in UK and US law - a person is presumed innocent until and unless they are proven guilty beyond reasonable doubt. Therefore, if/when a court reaches a "not-guilty" verdict, the defendant remains presumed innocent.

In fact, in the case of Knox and Sollecito on the murder-related charges, they have actually been legally and ethically innocent of those charges every single second since November 2007. The SC not-guilty verdicts merely confirm their abiding and everlasting status of innocence. Though I'm guessing that most of the idiots pro-guilt commentators probably don't even realise that Knox and Sollecito were considered legally/ethically innocent of these charges after the Massei verdict, after the Hellmann verdict, after the first SC ruling, and after the Nencini verdict - as well as after the most recent SC verdict. In Italy, every defendant is considered innocent in law/ethics until and unless the final SC ruling confirms a guilty verdict and conviction.

There is no way of knowing. AFAIK the innocent parties just want the abuse to stop, and are not interested in publicisizing actions like that.

Publicizing the action simply repeats and amplifies the abuse. IMO those hate sites will slowly disappear as (if indeed there are any) lawyers letters arrive and are either ignored or complied with. Because of the character of the innocents we may never know.

The ball is in the haters' court.

It is a loss: So much humor and what fun watching bannings and snipe troll hunts. While I always questioned their general mental balance I am now over whelmed by their off their heads comments. Here's one for fun:

In light of the corrupt verdict I have re-examined Kokomani's statements to see if he could have been intimidated to not cooperate fully. It's certainly possible that that's why his story became more outlandish as time went on. What I cannot get past is that the only car that was definitely parked with its headlights on during the period of interest was the broken-down car. The occupants saw nothing. How could they fail to see an altercation playing out on the street right next to them? The other car that is seen in the driveway about 10 minutes after that seems to me to be simply doing a three point turn. Unfortunately the defense has chosen to leak only specific frames rather than the whole evening's CCTV activity. We can only assume that it is in their interest to disclose anything that might point away from K and S, and since they did not disclose more clear evidence of a suspicious car it is probably not there.

I call for Maresca to release all the CCTV footage forthwith. They act like only the defense has access. Since we can be very sure it wasn't the defense that released the bloody bathroom picture and so much more why wouldn't the prosecution release or leak everything incriminating?

This raises an interesting question - before the 27 March exoneration, there was a determined effort to smear Knox and Raffaele with CCTV garage videos of a random woman, claimed to be Knox, a (court?) report printed in sans-serif font with the first names of people claimed to have been drug dealers - one of whom shares the same first name with someone Amanda met on a train..... what was the other one? Oh yes, Raffaele throwing Amanda under a bus, but it turns out the transit schedule was changed at the last minute......

Now? Post facto 27 March 2015? Crickets. Could this be the collapse of the vaunted PR-guilt lobby? Are they busy lawyering up, as would be wise?

You're right - Maresca must have had access to stuff Mignini/Crini was pushing. Why isn't he doing a data dump to demonstrate obvious guilt? It may just be that Section 5 of ISC finally got it right.
