In Scotland, the applications for compassionate release that have been refused, have been refused because they "haven't met the criteria". In other words, the prisoner's health wasn't actually as bad as was being claimed. Every one where the medical evidence has agreed that the prisioner's life span was estimated to be around three months, was granted.
Of course, if you have a very sensitive and embarrassing case, where there is an outstanding appeal which is being subjected to delay after delay so as to avoid some extremely embarrassing revelations coming out, this takes on a different perspective. You can't even rely on the appeal process ceasing when the prisoner dies, because there are a number of people saying publicly that they will continue the appeal in the hope of getting to the truth.
So if you can persuade the prisoner that his chances of getting home will be significantly improved if he abandons the appeal, well, it's all very useful, isn't it?
