Russ Faria might be getting a re-trial

Wow, great summaries.

I myself had trouble believing what I was reading about (and from!) this Pam Hupp character, what she did seems to make little sense if she actually murdered anyone, or was involved in any way, because it (should have) made her the number one suspect!
I just watched the videos. Pam Hupp states in one she did not enter the house when she visited Betsy Faria at the time of the murders. In a juxtaposed video she says she did. She had motive, she had opportunity, and she has the physical size and strength. We are dealing with a walking quacking duck, IMO.

I recommend the case as a study of comparisons with Mark Lundy, and the ability to be elsewhere, and being devoid of blood splatter while violently murdering one's wife.
 
If I am not mistaken, Mr. Faria's hearing is scheduled for this Friday.

Here's hoping that some semblance of sanity prevails (for once) in this case.
 
This is one of those cases of almost certain innocence not a case where I just don't think the evidence creates doubt.
 
There is virtually no way they can re-file against Hupp, aside from lack of evidence, as the prosecutor created reasonable doubt by going after Faria first.

I agree that she is free and clear but lets not then imprison Faria for the crime for the rest of his life. Now, I think that Hupp could be sued in a wrongful death case for every cent she could ever make in her life.
 
Came to post the hearing to see if he gets a new trial is set for the 5th but saw I was already beaten to it. Hopefully Russ gets a new trial (as I understand, the appellate court has essentially said he should and this hearing is more of a formality?).

I am not 100% sure but I strongly suspect that the prosecution will at some point decide to drop all charges, most likely just before the trial.

That's great news, indeed, although not surprising in light of the marching orders handed down by the higher court. Russ Faria's case has to be one of the most blatant of wrongful convictions that I have ever seen. I am astounded that Leah Askey had the audacity to say what she did in court today (assuming the report is accurate). What a piece of work she is; she should be disbarred if not prosecuted herself for perverting the course of justice.

She has to brazen her way through or all falls apart for her. . . . I just think somebody above her is going to tell her to drop it.

That has been my guess ever since he was convicted. No retrial and no Hupp indictment.
 
He won't. Unless, of course, he knows something that we don't. Which is always possible.

Frustration can be a powerful motivator. . . . . Look at Sarah Pearce who was convicted of attempting to murder Linda LeBrane.

I was just googling this week when the re-trial was going to start and couldn't find any news beyond the articles from this summer when he was released pending re-trial.
