It claims the court (Masipa) gave too much weight to mitigating factors and failed to take into account several more aggravating factors. It also addresses each point where the court "misdirected itself." It's a compelling argument.


Well, notwithstanding the fact that it's a prosecution appeal document (and thus must necessarily be viewed as possessing some degree of adversarial partisanship), it's a very striking document indeed. The sheer number of times the mantra "the court, with respect, misdirected itself" (or similar) is used is almost breathtaking. And assuming its interpretation of precedent and case law is correct, it's rather difficult to see how the appeal cannot have merit.

It seriously appears to me as if Masipa is either a) so terrifically incompetent that she isn't even cognisant of all the legal errors she made in the original CH verdict and now the murder sentencing; b) so personally stung by the reversal of her CH verdict and the professional/public opprobrium she received for it that she somehow decided to deliberately set the murder sentence incredibly low in reaction; or c) beholden to Pistorius in some way - either (unprofessionally) emotionally or (illegally) financially - resulting in the incorrect CH verdict and the "shockingly lenient" murder sentence. Whichever, I sincerely hope she gets removed from the SA criminal bench as a minimum, and gets investigated by the authorities/police at most.
 
I think people need to remember it's S.A. and the chick is jumping between death threats and bribed other judges and politicians

Judge Masipa has the talent and analytical mind to be a preeminent international jurist. I see her as totally outstanding. She has correctly navigated the shoals that incorporate pig ignorance, blind prejudice, and the totally absurd notion that she has been captured by White Man Good Black Man Bad construct.
She abhors violence against women , and accordingly sentenced a rapist to die in prioson.
Too tough for me.

Naturally you will defend the most incompetent judge in recent memory due to your irrational belief in OP's innocence.

When the whole world is out of step with you, it is time to consider that you might actually be wrong. Throughout this thread all you have had to offer is an argument from incredulity. You (and more importantly OP) need to look in the mirror.

LK, I believe what I type. You must be fair and believe that. This case is divided by two ideas.
1. He shot an unknown intruder armed with a Glock pistol in his bathroom.
2. He deliberately killed Reeva with his Glock pistol.

These ideas are wildly disparate, yet this thread has become obsessed with determining the acts are equivalent.

I hope I have made myself clear so the debate can become more focussed.

I accept this. But all evidence shows you are wrong. Your belief in OP's innocence is irrational and borders on religious fanaticism.

You can have any opinion you want. Some opinions are rubbish, others are supported by very good evidence. Yours fit the former.
 
While I disagree with Samson and think it is a case of domestic violence, I think that the believe is coming from a good place. One does not want to believe that a man will just murder his girlfriend in a fit on anger / rage. The problem of course is that it happens and far more often than we would like.

In addition, while he lacks the lower part of his legs, he is more athletic than 90% (or more) of the people on this forum. I include myself on that list and I suspect that I am more athletic than 75% of the people on this forum. Do not treat him as being disabled.

DF I have learned something simple since foxy knoxy.

These cases are simple.

OP did not want his valntine dead, he loved her for pitie's sake. Masipa got it right. OP is essentially a common man caught up in a gun obsessed world. Surely everyone can contemplate that?
 
I am a liberal in these matters, which makes me wish for absolution for aggressor and victim.

Laughable. Pistorius will rot in jail. It remains to see whether it's a ridiculous 6 years or more. My house is on more.

Your fixation on the beauty of Reeva is very creepy by the way.

They are. You can't shoot someone who is no threat to you without facing a charge of murder.
 
Masipa's leniency is quite confounding. I don't believe Oscar's lawyers believe he didn't know it was Reeva who was in the toilet stall. There's a fair number of the South Africans who think Oscar seriously thought an intruder was behind the door. I put that down to loyalty to Oscar and not wanting to think he's as violent and uncontrollable as one would have to be to kill the woman you've been seeing for 3 months on Valentine's day.

Personally, I believe he knew it was Reeva in the toilet stall. I believe the neighbours's accounts of having heard arguing on the night in question. I would hope he gets 25 years which he should serve in gen. pop. but unfortunately I doubt he'll get close to such a fitting sentence.

Given that history records many instances of attractive, successful women being attacked by their partners, I think your thinking here is not logical.


It doesn't actually matter. The facts of the case are that Oscar committed murder. He is a murderer.

Legally speaking your two points are not disparate. The point is did he shoot with reckless disregard or intent to kill someone. The fact that allegedly the person behind he door was not the person he thought is legally irrelevant in the sense that he intended to kill a person or fired his gun with reckless disregard of that person's life. This case is similar to a case in which a hired hitman is hired to kill X but through a mistake kills Y. This of course assumes that he was not intending to kill her specifically but was really mistaken about the identity of the person in the washroom. The point being that he intended to kill someone and / or acted with reckless disregard in which case he is a murderer.

Clearly not.

It seems to me that you're basing your admiration of her on the fact that there are about six people in the world who believe Oscar is the victim and you and Masipa are a third of that group.
