They took an oath to enforce the laws of the land. If they fail to do so they can be impeached.

But not all laws are sensible. Therefore they can be repealed. Continuing to keep a plant illegal that's no more harmful (or inhibiting) than alcohol or tobacco is not sensible. Especially when you consider the collateral effects (deaths, gangs using it as a income source, completely harmless people being jailed for having it, ect).
