Larry Silverstein Sues Airlines For $12.3 Billion

Has it ever been settled in the 9/11 case what kind of weapons the hijackers were able to get on the plane and what they didn't compared to what the people reported in the phone calls?

Not in court anyway.
i believe only 1 passenger (on flight 93) said he thought they might have guns, other passengers didnt mention it, at least one was specifically asked if they had guns and said he didnt see any (again these refer to 93)

no guns bullet or other evidence of firearms was found in in the wreckage and no gunshots were heard in phone calls or recorded on the CVR

i dont need a court to tell me the hijackers didnt have guns

Unless you’re going to be on the jury you never know what they'll decide. Remember OJ? The airlines have yet to show any desire to go to a jury trial on any 9/11 case so far. They've settled every time just as long as the people keep their mouths shut about what their lawyers found out. What is it the airlines are afraid will be revealed in a trial?

And it wasn't just guns. I believe they also claimed pepper spray, and bombs. Pepper spray was a banned item. Real or fake you shouldn't be able to get on with anything that even resembles a bomb or the makings of one. The TSA has been tested with fake bombs post 9/11. Needless to say they failed to stop them from getting on. A gun post 9/11 was also found past security check point in Tucson. So it wouldn't be unheard of that the hijackers got a gun on board pre-9/11. If your claim is none was found in any wreckage well then I would respond we haven't seen a whole lot of wreckage either.

so a jury deciding something automatically and automagically makes it true? juries are infallible? well thats good to know i suppose, guess we can take the stay off executions, theres no innocent men on death row ;)

BTW the airlines would have no power to prevent something from going to trial, remember the plaintiff has to accept the settlement for it to work

You might just as well ask why the plaintiffs are agreeing to settlements instead of going to trial to expose the deep, dark revelations that you allude to. Are the plaintiffs also afraid of what might be revealed about themselves in a trial? :rolleyes:

The airlines did not provide security - the airports contracted out security to private security firms. If anyone was going to be sued it should be them, shouldn't it?

I think any sort of narrow lawsuit is dangerous, because if creates a false sense of security - if only person X had done their job, 9/11 never would have happened. There's a reason the 9/11 Commission ultimately cited the blame for 9/11 as a systematic failure of the entire infrastructure - because that's what it was. Ultimately, who is to blame for not preventing 9/11 (note, this is distinct from "who is to blame for 9/11?")? The United States of America is to blame for not preventing 9/11. Every organisation, every citizen, failed. Singling out a handful of individual companies or people achieves nothing, because it doesn't solve the cultural and social failure which is at the root of it.

Filing a lawsuit does not = desire to go to trial. In fact, the vast majority of cases never go to trial. The vast majority of cases are settled prior to trial.

The point, which you missed, is that if you are going to suggest that settling indicates a lack of desire to go to trial on the part of on one party, it is illogical not to apply the same suggestion to the other party. One party cannot settle without the agreement of the other.

Perhaps. Perhaps not. Unless you are privy to the terms of the settlement, you have no idea.

Doesn't this mean the airlines, in order to prevent from being sued, should be at the forefront of supporting the truth movement? I mean seriously; wouldn't an inside job help their case?

I would imagine the rock-solid evidence being presented by the truth movement would be of great interest to the airlines now.

Maybe Lashl or one of the other lawyers here can pull up the lawsuit and get the details if they have time.


The 9/11 litigation initially consisted of thousands of claims against hundreds of defendants. Early on, they were divided up into three (eta) four master dockets in order to consolidate claims that were similar in nature, hoping to manage them in an orderly fashion.

The death and bodily injury claims relating to the flights and the WTC were consolidated on docket 21 MC 97; the respiratory claims were consolidated on docket 21 MC 100, the property damage claims were consolidated on docket 21 MC 101, (eta) and I cannot recall what the fourth category is at the moment on docket 21 MC 102.

It appears that the Silverstein entity claims that are the subject matter of this thread are actually cross-claims made as against co-defendants. In other words, the Silverstein entities were sued by the family members or injured parties along with the airline entities, airline security companies, engineering companies, etc., and the Silverstein entities cross-claimed against their co-defendants.

The docket report on 21 MC 97 alone is 266 pages long, and that's without the long list of the plaintiffs, defendants, and all of their lawyers, which would add approximately another 10 pages. There are currently 1443 documents listed on that docket.

At the moment, the cross-claims are not available on PACER as it appears that with so many documents filed, the older ones are not kept as active links after a few years.

However, it appears that on March 18, 2008, the judge who has had carriage of the 21 MC 97 docket decided that as it now has so few matters left (only 11 of its initial 96), it was no longer necessary to maintain the separate docket and ordered that the remaining matters be transferred to the 21 MC 101 docket, and that the cross-claims also be transferred to the 21 MC 101 docket.

At the same time, the court ruled that the Silverstein entities and the Port Authority entities (who have also cross-claimed against their co-defendants) are also to be transferred to docket 21 MC 101 under four new action numbers. The court also granted leave to the cross-claimants to amend their claims within 30 days, solely for the purpose of recasting them as direct claims: i.e. with the WTC Property entities (and the PA entities) as plaintiffs and with the airline entity co-defendants as defendants.

So, if the cross-claims are in fact amended in accordance with that docket entry, I should be able to obtain it and then we'll be able to see clearly the details of the matter.

Maybe Larry has just been watching the airlines settle with the remaining holdout family members one by one as long as they don't reveal anything they have found out along the way. He probably thinks it's a safe bet they'll settle with him also before it ever goes to trial.
