The 9/11 litigation initially consisted of thousands of claims against hundreds of defendants. Early on, they were divided up into
three (eta) four master dockets in order to consolidate claims that were similar in nature, hoping to manage them in an orderly fashion.
The death and bodily injury claims relating to the flights and the WTC were consolidated on docket 21 MC 97; the respiratory claims were consolidated on docket 21 MC 100, the property damage claims were consolidated on docket 21 MC 101, (eta) and I cannot recall what the fourth category is at the moment on docket 21 MC 102.
It appears that the Silverstein entity claims that are the subject matter of this thread are actually cross-claims made as against co-defendants. In other words, the Silverstein entities were sued by the family members or injured parties along with the airline entities, airline security companies, engineering companies, etc., and the Silverstein entities cross-claimed against their co-defendants.
The docket report on 21 MC 97 alone is 266 pages long, and that's without the long list of the plaintiffs, defendants, and all of their lawyers, which would add approximately another 10 pages. There are currently 1443 documents listed on that docket.
At the moment, the cross-claims are not available on PACER as it appears that with so many documents filed, the older ones are not kept as active links after a few years.
However, it appears that on March 18, 2008, the judge who has had carriage of the 21 MC 97 docket decided that as it now has so few matters left (only 11 of its initial 96), it was no longer necessary to maintain the separate docket and ordered that the remaining matters be transferred to the 21 MC 101 docket, and that the cross-claims also be transferred to the 21 MC 101 docket.
At the same time, the court ruled that the Silverstein entities and the Port Authority entities (who have also cross-claimed against their co-defendants) are also to be transferred to docket 21 MC 101 under four new action numbers. The court also granted leave to the cross-claimants to amend their claims within 30 days, solely for the purpose of recasting them as direct claims: i.e. with the WTC Property entities (and the PA entities) as plaintiffs and with the airline entity co-defendants as defendants.
So, if the cross-claims are in fact amended in accordance with that docket entry, I should be able to obtain it and then we'll be able to see clearly the details of the matter.
