There's an old lawyer's joke involving the mishandling of a firearm, whose punchline is that someone was charged with a "missed-de-wiener."

NEW YORK (AP) — Rudolph Giuliani, the former New York City mayor, federal prosecutor and legal adviser to Donald Trump, was disbarred in New York on Tuesday after a court found he repeatedly made false statements about Trump’s 2020 election loss.

The Manhattan appeals court ruled Giuliani, who had his New York law license suspended in 2021 for making false statements around the election, is no longer allowed to practice law in the state, effective immediately.

“The seriousness of respondent’s misconduct cannot be overstated,” the decision reads. Giuliani “flagrantly misused” his position and “baselessly attacked and undermined the integrity of this country’s electoral process.”

“In so doing, respondent not only deliberately violated some of the most fundamental tenets of the legal profession, but he also actively contributed to the national strife that has followed the 2020 Presidential election, for which he is entirely unrepentant,” the court wrote.

He says he’ll appeal the decision. Yep, unrepentant.
 
And even he hasn't really faced real consequences.

He's declared bankruptcy but is still living the high life. The winners in the lawsuit against him haven't seen a penny and neither are they ever likely to.

He can try. The Appellate Division hears cases as of right. The New York Court of Appeals has discretion and is not compelled to entertain an appeal. The findings of the Appellate Division are exceptionally strong, based in a number of cases on Giuliani's own stipulations. He argues the complaint against him was filled with false accusations, but if you cop to them you have a hard time making that argument stick.
 
Has it any consequences for him to be disbarred? How often does represent somebody in court? I mean other than himself ;)

He asserts that he either had a good-faith basis for believing his false claims at the times he made them, or else he "misspoke." :rolleyes:

They also cited his behavior during the disciplinary hearing as an aggravating factor:

“On the second day of the Hearing, October 11, 2023, Respondent accused counsel for the AGC of ‘possibly deliberately’ altering evidence. He then proceeded to engage in aback and forth with this Tribunal in which he was both sarcastic and disrespectful requiring his counsel to caution him... Later that day, Respondent accused this Tribunal of‘railroading’ him. He also made that same accusation again later in the proceedings. ... On two occasions, the Hearing had to be paused and the Respondent excused from the room with one of his attorneys because of his disruptive and disrespectful behavior.

“On October 24, 2023, Respondent verbally attacked counsel for the AGC and asserted that he was being unfairly treated and that the proceedings were ‘Completely political"... Respondent engaged in similar behavior numerous times throughout the hearing, On October 26th, Respondent walked out of the hearing twice. On the second occasion, this Tribunal noted that Respondent was yelling and making allegations about having members of the AGC jailed. .... On the last day of the Hearing, which was devoted to the issue of sanction, Respondent chose not to appear." (disbarment ruling, pp. 23-24)

I'm becoming more and more convinced that Giuliani has been suffering from some form of dementia for the past several years (as opposed to some of Trump's other attorneys, such as Sidney Powell and Lin Wood, who've probably just been lunatics their entire lives).

About the hilited, for anyone unfamiliar, this is New York's highest court, what's known as the Supreme Court in most jurisdictions. (What New York calls Supreme Court is what most jurisdictions call Superior Court. :boggled:)

On Tuesday, Lindell appeared on Steve Bannon's WarRoom show where guest hosts are filling in after Bannon surrendered himself to prison this week.

"Speaking of Rudy Giuliani...we hired him over at FrankSpeech.com. He's on my network now. He follows Steve Bannon, it's Steve Bannon, and then after him is Lou Dobbs and then myself," Lindell said.

That seems like a reasonable hypothesis.

To answer the question what consequences disbarment would have for him, my guess is none. I think Donald Trump was his last client, and he hasn't represented anyone since then. He stands to be disbarred in D.C. too. At this point it's safe to say his law career is over.

Indeed, the backwards naming of courts in New York is a running joke in the legal profession. California is a close second, with "Superior" courts organized at the trial level. These once stood in contrast to "Municipal" courts, but those no longer exist. There is nothing for Superior Courts to be superior to anymore.
 
This happened Wednesday, Giuliani facing possible jail time and the termination of his bankruptcy.
At the hearing on Wednesday morning, Rachel Strickland, lawyer for the two election workers who Giuliani defamed and now owes $148m, argued in favor of dismissing the Chapter 11 bankruptcy case. She said that she feared Giuliani would get a “hall pass” if the case was not dismissed, citing his pattern of filing late and inaccurate financial reports. Strickland then suggested that Giuliani had committed “bankruptcy crimes”, and that she would seek jail time, not financial repercussions. Independent
Rudy didn't take it well, interrupting Rachel Strickland by yelling over the phone. (This was a teleconference hearing.)
“Your honor, this is Rudolph Giuliani,” he told the judge, adding that Strickland’s comments were “highly defamatory, your honor.” Giuliani said he wanted a break but the judge said he would have to wait until after Strickland finished her presentation.

“Sir, everybody gets a chance to be heard but you cannot interrupt someone else while they’re being heard,” the judge said, before threatening to “cut his line off” if he didn’t stop talking.
