Explosion at the Boston Marathon.

They will question him WITHOUT reading him his Maranda Rights.

This has just been announced by ABC News.

That doesn't make any sense. Why would they set themselves up for an overturned conviction? Evidence obtained without having read the suspect his Miranda rights is inadmissible.
 
I am pretty sure they have in fact read him his rights.
And he will not face a death penalty.
 
Public Safety Exemption: they are going to ask him about other possible bombs and dangers to the public, before they inform him of his right to remain silent.
 
At least they arrested him on a boat, so there won't be any legal difficulties with charging him under admiralty law.
 
I could see questioning him without reading him his rights if he is so grievously wounded that he's not expected to live.
 
God, the size of his indictment is going to be huge.
Four counts of Murder, probably First Degree,for starters.
Every individual injured in the explosion is a seperate Felony.
Just planting the bomb probably broke federal anti terrorism laws.
And then there are minor charges liked armed robbery, carjacking, kidnapping (when he took a hostage he became a kidnapper) which you can put on top of the indictment sundae like a cherry and nuts.
Even if escapes the death penalty,if convicted,which is a lead pipe cinch ,he will never see the light of day again.

They can do that under the Terrorism Laws can't they?

Homeland Security can question a terror suspect without a lawyer present and without mirandarising them?

If that is challenged, a short trip to Gitmo will sort it out.

9:10 p.m ET: Suspect was injured by a “flash bang” grenade and is bleeding badly, federal sources tell ABC News. The extent of his injuries is unknown at this time.

What makes you say that? McVeigh?

Because Massachusetts does not have a death penalty, and I don't think (but IANAL) that the fed death penalty can override that. Also there may be alot of legal play ahead like Malvo did.
