Continuation Part 20: Amanda Knox/Raffaele Sollecito

I was looking for specifics. Ok, so you have none. No big.

It's clear the postals arrived just before 1 pm. But the whole issue is overblown anyway, other than that it shows a willingness for the postals to lie.

If they got the time wrong it can only have been a genuine mistake, because they recorded it in their notes which appeared in Matteini's report of 8 November.

So therefore
a. The postal police must have looked at their watch at 12:55 and read 12:35
b. There was a policeman wandering around with his hands above his head around 13:32, boots up to his mid thighs and a pink stripe on his trousers

Those readers who want the story behind (elected) Judge Heavey can update themselves here:

...And here: http://truejustice.org/ee/index.php?/tjmk/comments/judge_heaveys_open_letter_to_italy/

If anyone is coming out with soundbites, it's not me.

You brought up Judge Heavey - not me - as someone in Seattle who had nothing but glowing praise for Amanda. It's only right I point out that this is the slippery worthless praise of a mountebank snakeskin oil salesman.

You make me laugh. Now your slamming Judge Heavey. You think he was paid?

What's particularly funny is that Massei is a great jurist in the backwater town of Perugia in a previous first world country now third world but Heavey a jurist from Seattle one of the most dynamic and progressive cities in the world in a country that is a world leader but he is a snake-oil salesman.

I wonder if Mike might take the opportunity to expose a poster by going after the libel.

You very well could be right. Yet my memory of this, the eighth go-round of this issue, is that by the time they testified, the prosecution was using this mis-remembering to slander Raffaele as someone who with malice purposely called 112 AFTER the P.P. arrival. IIRC no one on the prosecution side at trial was being so generous that the P.P. simply could have read a "3" when it was a "5", assuming, even, that they had digital watches or read it from the time display in their cruiser.

I remember being batted about the ears by a nasty guilter someyears ago - where when the ad hominem was removed - claimed that this issue was part of "all the other evidence", such evidence promised after the Hellmann acquittal when even hardened gulters (back) then were resigned to the DNA "evidence" generated by Stefanoni was junk.

Who needs the DNA fantasy anyway? There is "all the other evidence", this issue of the timing of the 112-call//P.P. arrival being one of it.

Even back then, it was pointed out that Judge Massei back in 2009, even in convicting the pair, said that the P.P. arrived "just before 1 pm." So much for believing Mignini/Comodi on what was supposed to prop up the prosecution now that the DNA evidence was gone!

I wrote a piece for IIP basically saying two things - the best way to believe the Massei report is not to read it, as well as that even guilters did not believe Massei's conclusions. That was one of the weirder things to consider coming up to speed on the dynamics of this wrongful prosecution.

I was hoping you had a command of the specifics so as to remind me why Massei would rule against the prosecution - in essence disbelieve the P.P. own testimony. Oh well. Massei was stupid enough to simply ignore the P.P. claim that they'd gone in to lift the duvet, to see if, in fact, the victim had expired or maybe needed emergency attention.

Why that is important is that Raffaele had been banging on Meredith's door only minutes earlier, and the Massei Court disbelieved that contamination of the scene could have been an issue - even with the P.P. admitting they tracked in stuff on their shoes, so as to see if the victim was still alive or not.

Going down all these blind alleys is the proof I needed that there actually was no, "all the other evidence." Yet, essentially that's what Chieffi ruled in annulling the aquittals in 2013 - you have to take ALL the evidence "osmotically", no matter any one item's veracity.

Fast forward to Marasca/Bruno. Even when all this stuff is combined "synoptically", it is their view it still doesn't convict.

Vixen goes too far in his libel, knowing that most of the time her libel will go unaccounted.

Vixen may wish to rethink this strategy of libelling by saying the first thing that comes to her head, or by citing nutcase Peter Quennell's site.

If 100 people were having to decide who was the snake-oil salesman, my bet that 99.5 of them would say it was Quennell, and would hold Vixen accountable for the stupidity of passing it on.

Then again, do civil juries in the U.S. have 8 or 12 jurors? I always forget. I know that in the U.K. the libel laws are a little more stringent. Does anyone think that a U.K.court would ever be interested in this?

Bill Williams said:
So - where do you think Judge Massei erred in stating that the postal police arrived "just before 1 pm", with the heavy implication that it was after Raffaele had called 112?

As you have been told, this was a case of Massei bending over backwards for the kids. It was a case of whether or not the call was before or after was quite irrelevant to the verdict (=Guilty). By conceding minor issues to the defense, it was one less thing they could latch onto in an appeal.

Plus, he probably figured he might need Papa Raff's delicate surgery one day.

It is always incredible that you accuse even Judge Massei of judicial misconduct. You even have a conspiracy theory that, in essence, he was successfully bribed by the Sollecito's on this lone point.

That you actually want your opinions read is stunning.

It's not a question of 'believing' Massei, or any judge. A judge doesn't claim to be expert in everything, which is why they call in expert witnesses from both sides. It is extremely tough deciding which expert's view is more likely than another, especially when each are top of their field and passionate about their theory. Of course, judges are aware some experts are being paid to slant their views, albeit ethically in most cases, and they will also bear in mind the prosecution side overstating their case.

In fact it is. We're not talking about what judge Massei believes, but what you believe based on the evidence, not what a judge deterrmines.

You said that the phone at 10:13 was at the cottage. What Massei actually said was that it was near the cottage. Which is subjectively true. One could easily say the park was near the cottage, it is probably about 400 yards at most away. Both the park near where the phones were found and the cottage are roughly equidistant and have perfect lines of sight to the Wind cell antenna that connected the call. Can one know whether the phone was at either place or on Ponte Rio road right next to the cell antenna? I'm telling you VIXEN, that's it is IMPOSSIBLE to know. I'm only speculating based on lines of sight and the closeness of the Lupatelli tower.

Using the cell phone call data is a very blunt instrument. I watch these CSI shows and the abilities of this evidence is grossly exaggerated. It's also varies greatly from city to city and country to country.

It's not libel, as he was actually disciplined for unethical use of judiciary letterhead. I modified my post as I noted he was a war veteran, so does have basic good character.

Seattle has Amazon, Starbucks and Google, and brought us Jimi Hendrix and Curt Cobain, but it has its fair share of villains and rogues, just like any other city.

Judge Heavey was a King County Superior Court judge which encompasses more than Seattle proper. It includes Microsoft, Aldus, Real Networks, Boeing, PACCAR, etc and 2 million people.

Heavey was admonished for using the letterhead and that is the equivalent of being told not to do it again.
Heavey was a member of the State House of Representatives and the State Senate. He was a Superior Court Judge in the most populous county in North of San Francisco for 13 years.. He was an officer in the US Army and was awarded a Bronze Star.

A sitting US senator condemned the guilty verdicts, both times. Must have been on the PR payroll though, or perhaps was too stupid to understand the compelling evidence from bloodless, DNA-less, unmatched, undated stains on the floor.

The police did not "mis-remember". They meticulously record time of arrival as it happens and write up their report later.

This report clearly shows Raff rang 112 after the police arrived.

Battistelli has no motive to misrepresent the facts. Raff is Italian, like himself, remember?

ETA This is the report written up on the date of the discovery of the body, when there is no way anyone knew Amanda and Raff were suspects. Just ordinary cops doing their jobs.

Your unwavering trust in the Perugian police is admirable. Your argument is with Judge Massei - oh wait, you think Massei is corrupt.

This forces you to believe the CCTV clock was running fast then, and the carabinieri arrived before the door was even broke down, even though the carabinieri arrived after 13:29 and everyone was waiting outside after the discovery of the body. Working in Battistelli's second lie from that day is just so hard :(

Logic fails with Vixen.

Hey Vixen, where was Meredith's cell phone at 22:13 on November 1st 2007?

Heavey was a Superior Court Judge, right?

Yes after being a prosecutor, Representative and State Senator.

I wasn't referring to the mild reprimand he received, but rather your calling him a snakeskin-oil salesman etc.

We also have Boeing, Nintendo, Russell Investments, the Seahawks, Sounders, Mariners and one of the highest rated universities in the world.

Please don't put words in my mouth. Nowhere have I said he's corrupt. He's wise and diplomatic.

Vixen will you sign my copy of People magazine
