Continuation Part Eight: Discussion of the Amanda Knox/Raffaele Sollecito case

Is it a hair strand or fiber?

Greetings all,
Over the years some have posted their thoughts that the hair strand seen in the photograph below,
found in Miss Kercher's dying grasp is instead a fabric fiber.

Could be...

But I'd wager that with another 1 found also near her naked genitalia,
it is crime related.

Look at Meredith's hand.

It was found upraised.
Doesn't that strike you as odd?
What a strange angle for her arm and hand to be found, upraised...

Her hand, neither of them from what I can recall, was not found covering her horribly gashed throat, which was bleeding profusely then as Meredith was choking on her own blood trying to breath as she was most likely being raped.

Nor was this arm and hand in that photo simply lying by her side.

It's upraised, which I believe, has some significance. But what?

Was Meredith, as death came,
simply trying to speak yell out and point to her attacker by raising a hand that she might have used to strike back at someone attacking and raping her? Which when found, shows her clutching a strand of this person, (a friend of Rudy Guede's), hair.

Or was Meredith, while still alive, covered by the duvet
and that hair is simply a fiber pulled from that duvet seen covering her in that other photograph above?

If you think so, here's a question for you:
Why would there be another similar hair found near her vagina?
1 that was also conveniently "lost" by Italian law enforcement?

When I reviewed his publication record some time ago, I came to the conclusion that Dr. Novelli's main interest was medical genetics, but he also had an interest in single nucleotide polymorphisms (SNPs) as a possible tool in forensics. Dr. Novelli's medical genetics background was worse that irrelevant to this case; it was actually a reason that the court went off in the wrong direction. My understanding is that he testified to the effect that they could do PCR on as little as a single cell in his lab. On page 83 of Math on Trial Schneps and Colmez wrote, "In court on September 5 [2011] and supported by expert prosecution witness Giuseppe Novelli, Stefanoni explained that newer generations of DNA analysis kits existed in 2011 that had not been available in 2007, and these new kits could give results on as small as a couple of cells."

Wait a minute; newer generations of kits are nice, but they don't address the issue surrounding low template DNA and all of the problems that such analysis has. In embryology one knows the origin of the single cell one is testing (see my previous comment), but in forensics it is impossible to interrogate the DNA as to the time or manner of its deposition. Dr. Budowle, for example, has written that low template analysis should be restricted to identification of bodies and to developing leads but not in criminal proceedings. Identification of bodies and developing leads are much closer to criminal proceedings than embryology is. In other words using the practices in embryology to justify further testing on the knife was intellectually suspect. Then when the results were exculpatory, the prosecution and its allies minimized their significance.
Yes that's all very well but DNA doesn't fly and you still haven't proved the source of contamination so tough.

Seriously, for a second, this one is actually interesting (don't take that the wrong way, Chris).

That hair bothers me. In the Texas case of Darlie Routier a hair, supposedly of hers, was found by the screen window the intruder was supposed to have cut to get in her house. It formed part of the case against her until it was found to belong to one of the female police officers who investigated the crime. All the evidence in this case points to a lone attacker. Could the hair(s) be an anomaly? Or is it being suggested that two (or more) people attacked her but only one of them left foot prints, DNA, fingerprints etc?

I'll assume the hairs were tested beyond the tools recommended capability to see if it was against Amanda, when they didnt see anything to support Migninnis case against Amanda, it probably disappeared or was accidentally destroyed on purpose.

Thank you for praising my post. I am disappointed no one has answered the issue raised in my post. Another factor which indicated the prosecution had no case was relying on dubious forensic evidence. For instance, the knife did not match the wounds. Basic logic says a knife should match the wounds and if a knife does not match the wounds, it can not be the murder weapon. Having to resort to using evidence which could not be used in a crime is a sign of desperation and a clear sign the prosecution had no evidence against Amanda and Raffaele. It is beyond me how the PGP can argue the prosecution had a strong case when the best the prosecution could come up with was a knife which did not match the wounds.
.
I have no problem understanding that there are huge numbers of Internet freaks that love to cause pain to others. Just read the gratuitous comments on youtube videos to see how common they are.

But the judges, with the exception of Hellman and Zanetti, are the ones I don't get. Why do experienced judges not see, or choose to ignore the dishonesty, corruption and incompetence of the prosecuting team. It is beyond me how these judges use the opposite of common sense to arrive at conclusions.

There is a local burglar that had no business being in Meredith's apartment, but was positively there before, during, and after her murder. He left foot prints, hand prints, DNA on her body, DNA in her body, DNA on her purse. He made up a cockamamie story about having a date with Meredith, going to the bathroom and coming out to find Meredith murdered. There is a broken window, just like at the lawyers office that had items stolen that were found in his possession. He admits to drinking juice from a container in the fridge and using the toilet. In other words he is behaving just like he did when he broke into the kid's school and made himself at home, and no doubt his neighbor's house also where he made himself a meal, robbed her, and set fire to the place.

But, the brilliant cops decide he must be some poor clueless schmuck who was duped by Amanda to murder Amanda's friend and roommate. And Raffaele helped. Why?????????? It is an insane accusation just like Mignini's accusations in the Narducci case. He has a track history that started before Merdith even came to that Perugian crap hole that cost her her life.

You are totally correct Welshman, the concocted evidence the police have against Amanda and Raffaele is a sign that they have no case against them. And there is a simple and obvious reason for that. Raffaele and Amanda had nothing to do with Meredith's murder. Zip. Nada. It is dead nuts obvious.

Mignini is a hoax. He cares nothing about Meredith, the Kerchers, or Rudy's future victims. That goes double for Maresca.

When it became clear that Lumumba was not guilty, and that Rudy obviously was involved, Mignini and his minions had a choice.

a) Decide they had been wrong and probably bullied Amanda into making a false statement about Lumumba.

b) Decide that the only reason they could possibly have been wrong is because a dangerously intelligent, scheming, conniving seductress had beguiled them through no fault of their own and therefore she must be guilty.

Their egos did the deciding.

Should not the judges with the Norfolk Four and the West Memphis Three have known better as well?

With Giuliano Mignini prepared to sue Raffaele for having an opinion, and with this case now firmoly out of his hands.... it is good to review the things Mignini has been up to in the past....

My personal favourite is the Drama Queen one. Also how Andrea Vogt and Machiavelli are less concerned with prosecuting the right people, than they are with rescuing Mignini's reputation.

You may want to add this gem to the list Bill.

I've had the same question carlofab. Legally, I guess Italy could keep asking for extradition every year, hoping for a different answer. Now, Obama could issue Amanda a full pardon and then I believe Italy could get nowhere with a new administration.

That said, I serious doubt that Obama will be president at the time that Italy might ask for Amanda. Never the less, I can't imagine Italy requesting extradition of Amanda multiple times. That said, I couldn't imagine that we would be in the scenario that we are now.

The only crime Obama or any President of the USA could issue is for the noise ticket.

The crime of murder was committed in Italy. Maybe we can add an amendment that allows the president to pardon US citizens, or anybody for that matter, anywhere in world.

Yes that's all very well but DNA doesn't fly and you still haven't proved the source of contamination so tough.

Seriously, for a second, this one is actually interesting (don't take that the wrong way, Chris).

It does too fly. That's why they need positive pressure hoods in LCN labs.

Oh you knew that :o

Chris and others here should write a book on this just like the math people.

errors of the CSC

One, the CSC chose to trust a prosecution witness over a pair of independent witnesses. How can the defense ever mount a challenge to the evidence under those circumstances? Two, the CSC chose to believe someone with less relevant experience (Novelli) over people who had more relevant experience (Conti and Vecchiotti). Three, the CSC chose to believe someone who was saying things that were dubious or even nonsensical in at least two areas. I have now given a citation that demonstrates that Novelli's comparison between what is done in embryology (presumably pre-implantation genetic diagnosis) to what is done in forensics is flawed. Novelli pushed for a standard (that the route of contamination must be proved) that would exclude known, well-studied cases of DNA contamination.

You are right. The President's right to pardon is limited to crimes against the United States. I had imagined that the President could issue a pardon for any American who had committed a crime. That of course wouldn't protect you if abroad, but it would if you were within the US.

So, from what I can see, Italy could ask the US to extradite Amanda every year and the only US institution that could protect her permanently might be the US Supreme Court by them saying that it would amount to double jeopardy or it amounted to some other Constitutional infraction.

I would argue that as long as it is in writing that the US will not extradite her, it becomes a contract. If the US then tries to extradite her later, they are breaking the contract.

Second, the way the way the treaty is written, it allows some loose interpretation. A lower judge could simply judge that Italy has not proven guilt. It is not then a constitutional issue and do not see the Supreme Court ever seeing it.

This is of course all hypothetical. I can't imagine Italy's request being denied and them asking a second time. However, I don't think that would equal a contract. It certainly wouldn't be between the US and Amanda and a contract is an agreement between two parties. Italy isn't agreeing to anything. The US is basically just telling them no.

It could be argued that extraditing Amanda after denying a previous request for extradition would constitute double jeopardy as well. But I think that is a stretch as well.

Interesting scenario to discuss, but I very much doubt it will ever come to that.

The criminal investigations against Guede......not restricted to receiving stolen goods.....but also for the crimes of theft and illegal weapon possession...

Where does the part about theft and illegal weapons charges come from - not the link above?

The fact that the system wasn't turned on but the thieve was able to disable the phone dialer has made me wonder if Rudy actually did the burglary or if he had assistance.

Maybe not Grinder. This kind of info has been all over the web for years. Rudy may not have been a genius, but Rudy did know how to use the Internet.

Luca Maori....about 2/3rds down the page.

Are referring to this?

It is about… This may also be useful to the attorney because it indicated the number of criminal proceedings of Rudy Guede, an error note is made dated 1 February 2008 by the Prosecutor, the Deputy D’amico, who is in fact conducting an investigation against Rudy Guede for the crime of theft, receiving stolen goods and for the crime of illegal weapon possession. Law 110 of ‘ 75. This designation has also been provided to the Prosecutor’s Office in Perugia, to Dr. Male, by fax.

If so, it doesn't indicate that charges were filed.
