Brian Dunning lawsuit

Continued to January 23rd

The parties would like to continue the date for the evidentiary hearing from the above- scheduled time and date to Thursday, January 23, 2014, at 9:00 a.m.
2. The reason is to allow the parties to continue to meet and confer in an effort to reach a stipulated loss and restitution figure, as well as to continue to have Mr. Dunning’s hearing occur after that of related defendant Shawn Hogan (CR 10-00495 EJD). Mr. Hogan’s evidentiary hearing was recently continued to December 11, 2013, primarily to permit the parties to participate in a settlement conference with The Honorable Laurel Beeler, United States Magistrate Judge. In light of the Christmas holiday, the next feasible date for Mr. Dunning’s hearing is, the parties respectfully submit, the date we have agreed to.
 
To be fair, Kickstarter does not allow someone to stop receiving pledges once the funding goal is reached, so he actually can't stop people from giving him more money. However, a nice thing to do is to have stretch goals for the extra funding, and moreover, he's actively encouraging people to keep pledging money after the goal is reached, and he's a shady guy all around and a criminal so, yeah... -_-

Okay, so. The reward tiers are actually products, you know. He's also encouraging people to buy a tier.

At least, that is the explanation I'd reach to first.
 
It's amazing (to me, anyway) how long these things drag out.
 
Dragging out the lawsuit

It all depends on the courts schedule, how busy they are, how important the case is, etc. Some courts are very busy, so they have to juggle cases in order to get the most important stuff done first. It is a little odd that it has taken a criminal case more than 3 years to come to a conclusion.

Dunning recently appeared on Joe Rogan's podcast. Rogan claims to be the man "who asks all the questions", but of course the topic of his court case wasn't mentioned. As someone who listens to Rogan fairly often, I was surprised because he almost always brings up lawsuits that his guests are involved in.

That being said, not a great appearance for Dunning or skeptics in general. He was too combative, too cynical, and the message didn't come across very well. And this is coming from me (a skeptic of course.)
 
Sentencing has been scheduled

According to PACER, sentencing for Dunning is scheduled for April 28, 2014, pending a report from the Federal Probation Office.
 
Dunning seems to think he won't get any jail time, since he already has an appearance scheduled for May 2014. I would think he would be remanded to the Federal Bureau of Prisons immediately after sentencing. Wishful thinking, or trying to keep up appearances?

It's better to make plans and then cancel them if necessary. But I'll be surprised if he does jail time for this.
 
He plead guilty to a felony. I would be very surprised if he didn't get any time (unless you know something I don't).
 
Is there a civil suit pending? I'm trying to wade through all the linked papers, but I thought I saw a post mention a pending civil suit (by Ebay I guess?) that was awaiting the outcome of the criminal trial.

And did I read the case correctly in seeing he (or all the defendants? I wasn't sure who made up the "Flying Circus" group) has to pay restitution of $25,000? That seems quite a distance from the millions they originally claimed in losses. Can they sue for (and reasonably expect to be awarded) more in civil court?
 
Dunning's sentencing has now been pushed back to June 2nd, according to court papers filed with PACER.

Over a year from plea agreement to sentencing, what madness is this?
