Brian Dunning lawsuit

I guess they have higher profile crooks to sentence first.

It is curious, but I wouldn't be looking to Dunning as a source of information about what is going on. After the self serving snow job he put forth about his involvement, I think it's fair to assign him to the low credibility pool of humans.
 
Just to be clear, I am getting my information from PACER, the US Federal Court document system, not Dunning.

Sorry, I didn't mean to imply differently. The information that I was referring to was information that hasn't been released publicly about why this thing has dragged on like it has. This has to be really crappy for him, unless he's involved in a secret negotiation that has given him an idea about the extent of his penalties.

The prosecutor and the defense attorney have already come to a plea deal, so it is now solely up to the judge to determine Dunning's sentence, there are no more negotiations. The judge generally goes by the guidelines laid out in the plea deal, but (and I maybe wrong here) doesn't necessarily have to. We will have to wait and see what happens.

So why did Dunning's case take so long to resolve? Didn't the more active participant in this fraud just get sentenced? Why is Dunning going to be sentenced after him? Was this case typical for white collar fraud cases with regards to the length of time it has taken before sentencing, especially when there wasn't a trial.

Those are all good questions, for which I have no answer. You would have to ask the judge. However, I did fail to mention that prior to sentencing the Federal Office of Probation issues a report regarding sentencing the defendant and gives it to the judge. The judge uses the report to help determine the sentence for the defendant. I believe the defendant is allowed offer his own evidence to the judge and challenge the report. The judge then passes sentence. Looking at the postponement on PACER, I believe Dunning's attorney said he needed more time to gather evidence for present to the judge before sentencing.
 
Civil Suit Dismissed

Last week, the civil lawsuit against Dunning filed by Ebay was dismissed with both parties consent and both parties will pay their own attorney's fees, so I guess that is that. All that is left now is the criminal case.
 
I heard a rumor that there were copies of his confession floating around the Del Mar at TAM XII tonight. Anyone know what's up with that?
 
Not sure he "confessed." He said a lot of foolish things to that FBI Tech that visited his house, and there is the plea bargain that is not public yet. When he is sentenced, I assume he will eloqut to the crime (sp).

You're right. He didn't confess; he plead guilty.
