Continuation Part 5: Discussion of the Amanda Knox/Raffaele Sollecito case

I mean, even in their version, what's wrong with the process. They haerd the testimony of the homeless guy and found it not credible. That's how it operates usually.

It has long been contended by the PGP that Hellmann turned over the decision making on the DNA to independent experts which is not legal. The Florentine court could rule that the DNA is suspect because of the same reasons that C&V said but do it on their own and motivate it on their own.

PS - Anglo, I'd say it wasn't otiose but a little too subtle for you to understand :p

ETA - she would probably be allowed to serve her time at Purdy or maybe Spencer's Steak House. By the time the Italians finish with this, she will probably have kids in school and the US won't want to punish them and will give her house arrest or she'll just take her fortune to Brazil. This should boost book sales and make for a bigger movie pay day.

I wished we knew more about the relationship between Florence and Rome. I also wonder why the SC gave it to them.

What does this mean? How can they overturn Raf leaving the country, especially if he already has left?

There appears to be a blogger that has been badgering the Swiss authorities about Raf's work permit and convinced them to reject it.

I can't believe that the SC went with erotic sex game gone bad. They could have just said something about procedure blah, blah, blah but this isn't playing well anywhere.

It was the blog Simple Justice in December of 2009 that first alerted me to the fact that there was no evidence for this, and Mignini just rammed words into Amanda's mouth in his closing remarks. Unbelievable.

Strangely I have other things to do these days, but could you bring me up to speed....

Just what was it about rejecting the "sex game gone wrong" that offends law or procedure? In that case, it was Massei, not Hellmann, who rejected it.

Remember the good old days when the backbone of the case against Knox and Sollecito was the superwitnesses and the DNA?

Did the SC motivations say anything at all about those two things?

I am also assuming that the only things the Florentine court is required to consider is what is mentioned in the SC motivations.... I mean, why risk a future SC throwing it back yet again for not reading the tea leaves right...

... but also that as a fact finding trial the Florentine court is free to consider or reconsider anything else....

So maybe they will miraculously find a lump of DNA under the knife handle... or there will be found yet another public-square denizen who'll remember (now 6 years later) two students passing through at a time, this time closer to a reasonable TOD.

The newspapers had Hellmann syaing that bit about "there's legal reality and then there's real reality" in the days following the Oct 2011 acquittals... making it seem like Hellmann didn't mean what he said. Because in Dec 2011 there was no question that Hellmann thought the pair stone cold innocent.

That may be a lesson for us all to actually read the SC motivations report, rather than get summaries off the newspapers. I mean, it's not as if newspapers have ever played a role in poisoning the well of understanding in this case(!!!).

But if it comes down to multiples attackers, and that the SC really DOES think it was a sex-game gone wrong.... then........ :jaw-dropp

I mean.... what about the DNA? The superwitnesses? The SC seems intent on deciding this on "all the other evidence" which is so much vapourware to begin with...

This will be great when they get to trying to prove the sex game. Maybe the Florentine prosecutors will use the MOF case to help their case. Will the prosecutor be from Florence? Will it be someone involved in the prosecution of Mignini? Perhaps they will test the "semen" stain now and see if it matches a second male to substantiated the sex game theory.

There is plenty of evidence in this case but no evidence of this sex game.

ETA - what happens if the prosecutor just can't bring himself to make the sex game case and they convict anyway? Will the SC return it because it didn't involve sex?

Indeed. I expect Knox will be petitioning the authorities to allow her to serve out her time at Walla Walla.

As Humanity Blues once said: "It's over."

Only, this time, it is. Buh-bye Amanda. :v:

Yes, "a great day for racial justice".

That was you, in case you've forgotten.

What did you mean by it?

That is absolutely appalling.Rolfe.

It often seems like a game, doesn't it, these "blog wars", forum sniping and what have you?

Then **** like this makes you realise it might be deadly serious.

He has been a key proponent for the theory that AK is a Nazi racist. He either is himself a minority or the defender of minorities against racism.

It would be great if he would explain what the chief meant by knowing what was correct before AK buckled but alas he hasn't for 5 years and probably won't now.

In their weird theory factory the PGP believe that AK wanted to blame a black man after setting up a black man but not that black man. Hicham in their minds was a first attempt to blame the black.

The picture of AK with the WWI machine gun and the attribution of a barista is all they need, much like the "rape" prank.

OT - Just yesterday the running washing machine came back in play and none of them remembered Stewart2000 their very own court reporter telling them that the machine wasn't full of warm wash only wet wash. Even at the time that reporting drew the ire of TM and others as they so much wanted that and the bleach receipts to be true.

At least he spared us the shagging emoticon.

The simplest explanation is that Stilicho is what he hates, a "racist" (if there is such a thing - to me it's just a meaningless label from the PC lexicon).

What is the ISC thinking?

The best I can do is that the SC seems to be ruling that this is only one aspect of a larger, loosely assembled circumstantial case that Hellmann wrongly dismissed.

The SC seems to be saying that if there are all sorts of, even unconnected elements of fact there is actually no need for a unifying narrative pointing to guilt. The SC seems to be saying that it is correct to do what Massei did - simply invent things (like Knox innocently carrying the kitchen knife for protection - something the prosecution didn't even claim) to bolster a wide ranging "feeling" that they might be guilty.

If we assume as someone here suggested that the Supremes were not following the case closely but did read or at least scan the bs in the newspapers leading up to the first trial they probably don't like how Hellman did not re-review much of this "evidence" in the appeal - at least as expressed in the appeal court motivation report. The most positive explanation is that the Supremes want a trial that ties up all the loose ends, makes its own decision on the DNA evidence (Hellmann just "accepted" C&V conclusions (the only intelligent and rational man in Italy) puts Guede at the center and forefront of the crime and (hopefully I think) makes a sensible decision. IMO any sensible decision has to find AK & RS innocent.

Does the Florence Court take new testimony? I have a practical reason for asking.

Hellmann took new testimony and reviewed old testimony. This is supposed to be a trial de novo so one would presume the answer is yes.
