Continuation Part 5: Discussion of the Amanda Knox/Raffaele Sollecito case

Not open for further replies.
This is an astonishingly accurate summary of what's left of "the guilter case".
The difficult part is to put this into a comprehensive narrative of the case which includes the two students.

Getting back to John Follain, and the "key piece" you note above.... it is telling that Follain deals with the interrogation in a few paragraphs, and there's nothing about Knox being called a liar. Anna Donnino is only mentioned as "the interpretor". He barely mentions Ficarra catching Knox in the lie about drug use - used for the rest of the night as the main lever in the continual calling Knox a liar, liar.

Acc. to Follain, the only one notable for noticing Knox's "emotional shock," of seemingly having Sollecito's alibi withdrawn was the interpreter, one of only two references in the text to an interpreter being there.

It's amazing the brevity with which Follain covers this critical period. Of course his narrative has chamomile tea and biscuits.... but consider this:

Given that Knox and Sollecito were jailed and denied lawyers under provisions reserved for Mafia... is it reasonable to assume that at one point they were treated with kid gloves, and THEN treated like Mafia?

This is where Follain could have departed from simply describing why the cops were right in suspecting them, and go into some analysis of his own.

Oh wait. He owes Mignini. Follain had escaped being charged with defamation along with Curt and Edda.... I keep forgetting. Follain owes Mignini one.

Follain is Migninis whore. He actually had to delay publication of his novel after the appeal ruling to modify the story he had already clearly written...and while he appears less a fool for that it is clear he is in Migninis pocket and you hit nail of proof cleanly on the head...Mignini failed to charge Follain with crimes that he felt the need to charge AK parents with. And yet Mignini has clearly filed charges against other reporters and newspapers.

And yet no one investigates this corrupt fraud masquerading as Italian Justice.

I read an interesting statistic the other day. The highest per capita crime rate in the world is in Vatican City. It seems the Italian pick pockets work hard there to help the tourists from the extra burden of the weight of their wallets...

In Italy lying seems to be an Olympic sport rather than a sin or even a vice. Its apparently the 9 Commandments for Italians...who knew?

The question is; what dirt has Mignini accrued via these methods over the years and decades, and exactly how much 'leverage' does it give him in the higher courts?

The recording of Mignini's interrogation of Amanda would offer protection from any dirt Mignini might throw ones way. While Mignini is in the interrogation room he can't know that there is nobody in the control room. If anyone thought Mignini might have dirt on them, this opportunity would not be waisted.

Gubbiotti's Lie?

Gubbiotti, who is the cop who unpackaged the knife and put it into the calendar box, claims that he could not have contaminated the knife because even though he had been at the cottage earlier in the day (on November 6), he worked exclusively in Knox's room and didn't handle Kercher DNA.

But is this demonstrably a lie? Can anyone identify any samples from Knox's room that were collected on 11/6? I've looked at the Reps. list and I think that the only Knox Reps. that I can find from 11/6 are items that were seized from her person and not from her room in the cottage. So, if he wasn't collecting evidence from Knox's room, what exactly was Gubbiotti doing in the cottage on 11/6?

Moreover, what I do see are samples of "presumed blood" that were collected from Knox's room on 12/18. How could Gubbiotti have spent so much time in Knox's room on 11/6, yet fail to collect any evidence, and fail to notice "presumed blood" that was found a month later on Knox's wall and nightstand?

Is anyone aware of any photos or videos of the 11/6 investigation at the cottage that would show what Gubbiotti was doing?

So much expertise, so few facts... I'm busy searching the Seattle news sources for unsolved murders before 2007. I'll get back to you when I find any that resulted from sex games gone wrong.

OUCH!

Dont forget the MO...leaves skid mark in toilet...that should narrow it down considerably...

If you want the name of the bookkeeper I can refer you to Mr Grinder...I only know her specialty... Vogts expert on DNA. Susshhhhhh.

ETA...I apparently have not been keeping up...(my son is trying to kill me and lets just leave that at that)...but I was sure the bookkeeper was the DNA expert...maybe she was the expert psychologist, student, blogger?

I am so dying to come up with a funny retort to this one but I'll just leave it be. :D

Google luciferina and report back on what comes up....that should be good for a laugh. Or maybe just a sad commentary of the general population of Italy.

Somewhere there are images of blood on AK pillow...right about in the area where ones bleeding pierced ear might lie...or is it lay? Dyslexia is a terrible thing and such a tough word to spell for a dyslexic...sigh.

I agree that Gubbiotti is less than forthcoming about his anti contamination efforts...just the fact that he visited both places in one day makes him and his evidence worthless IMO..did he touch the door handle to MK room? Who knows. I bet there is some rule in DNA collection where CSI would not visit the suspects home on the same day as the visit to the victims home...unless?????

That pillow case was collected by the Scientific Police on December 18 (it's Rep. 172). It's hard to believe this Gubbiotti story that he spent the whole morning of 11/6 in Knox's little bedroom, didn't collect a single sample, missed the blood on the pillow, and in the meantime, the rest of the team collected over two dozen samples, a large number of which would have been Kercher's blood, and Gubbiotti never went near all of this activity.

Apparently some over there - the three year law student in particular - think that because I add up Rudi's evidence, I miss the need to add up Amanda's evidence. The problem with the theory is that Amanda's and Raf's so-called evidence is either only compatible with them (footprints) or unremarkable in where it was found. Amanda's DNA in her bathroom for example has no probative value, even if mixed with Meredith's blood, when the swab was dragged along the sink. Perhaps Anglo can chime in about what law school does to the ability to discern.

Since the ICSI didn't swab the areas next to the footprints, it is not known if Amanda's DNA was there as well as in the undated footprints that tested negative for blood. The nature of Luminol discovered blood is that it could have been there for years like the dinosaur examples the PGP so loved. That blood could and most likely was in a very weak mixture that could have come from a small amount of blood in shower floor water or the bidet.

In the case of Rudi the shoe prints MATCH his shoes coming from box found in his apartment. His prints palm or finger were found left in blood in the murder room. His DNA was found on and about the body and clothes. His DNA was found on her purse. This DNA was found using normal DNA techniques. Without the police being in his presence, Rudi told his friend via Skype that he was there when Meredith died

I would hope that this alleged lawyer could see the difference.

Once again, unless I missed it, this crack attorney can't give a reasonable explanation what the police chief meant when he said that the police knew what was correct before Amanda named Patrick.

I will gladly concede that anyone alleging that the DNA on the clasp went bad in some way in 47 days had better have some science backing that remark. If those of us that are not PGP cataloged idiotic comments by them on various sites and comment threads we too could pull totally inane remarks or theories. just yesterday some fool was speculating that Rudi went to Germany to rendezvous with Amanda. Another member speculated that Switzerland as member of the EU (they are not) would have to return them to Italy.

They attack professionals speaking about this case in their own fields yet were the ones that used a fashion house receptionist as their DNA expert and their top "journalist" Vogt actually used Nicki as a source.

No independent expert in DNA has stepped forward backing Steffy's work and no, ILE experts don't count.

J, remember the bleach receipts the PGP still talk about?

I'm guessing that their lawyer is more likely to work traffic court than criminal court. No defense lawyer worth anything wouldn't miss seeing that the ILE blew it. They didn't convict her beyond a reasonable for sure, even with the lame defense work done in the first trial.

ETA - Mary you will be happy to know that our 3YLS (three year law student) is now using the blog comment by JOH as proof that Amanda was involved in the famous rape prank in Seattle. You may wish to dig into this as most likely she must have been knocked off if she hasn't come forward yet.

They also reference a message sent to Meredith's sister about a quarrel with Amanda. No proof, no content, no problem.

They also seem to forget what's now known about the interests and low maturity levels of the 3 accused at that time (knives, manga, pranks, costumes for Halloween, RS's photo of himself in "Dexter" garb, replete with a meat cleaver in one hand and a bottle of bleach in the other, RG's BIZARRE vampire video, public expressions of a commitment to thrill seeking, indulging in street drugs of unknown composition/ purity, etc., etc.

Yup low maturity level for wearing costumes and a bottle of bleach.

I am still waiting for this famed lawperson to expand on his theory that Amanda deleted Lumumba's text intentionally so as to be able later to palm off her misdirection that she had gone to meet him. Maybe her Italian wasn't so bad after all and she really did want it to be understood as, 'see you later, as in right now'.

Are you saying that 3YLS thinks that she responded to Patrick in order to set up her for the later "accusation". She truly is brilliant. As I understand it she had planned the murder while still in Seattle.

Once again, we have theories of pranks gone wrong (look out for TM ;)) which don't explain Rudi or Curatolo or the TOD or Nara but what the hell.

Why doesn’t “Clive” explore the possibility that Knox not only deleted the text from PL, but deleted it knowing that doing so might help her to implicate PL? By retaining her ‘see you later’ reply to PL while, at one and the same time, deleting PL’s original text, she might have created some ‘wiggle room’ for herself vis-à-vis the content of that original text in the event that: 1) the content data was not retained on the Italian server(s) in question (perhaps a tech savvy Sollecito advised her on this point); 2) the content data on her SIM card had been overwritten by the text messages that she received between Nov.2 and Nov. 5; & 3) the content data on PL’s SIM card had been similarly overwritten during that period as well.

The first sentence above shows the tendency to counter PIP arguments with the same style of PGP argumentation. Throw out AK and you also have to throw out RG. It reminds me of what Peggy's own reaction was to the Hellmann report.... "If you throw out the forensics against AK and RS, then shouldn't they throw out the forensics against RG?"

Ah, er, no Peggy. We're talking apples and oranges on that score... and if you'd only bother to try to put together a comprehensive timeline and theory of this crime, and its investigation, you will see why. At the end of the first round of forensic recovery, ALL the forensics pointed to Rudy. With the exception of a knife found at Sollecito's... which can only be called "forensics" connected to this crime because of a striation on that knife that no one else can see, based on a piece of DNA so small that it could be tested for only one, but not both, of either what it was made of or who it belonged to.

Your three-year lawyer, Grinder, simply wants to extend this really weak piece of reasoning.... to try to line up the "evidence against" AK and RS beside the evidence against RG, and try to brow beat you into accepting that every time you cross off something against the students, some unknown logical principle requires you to to cross off something against RG; perhaps only for fairness's sake.

Fairness to whom? This is a subset of "let's protect Rudy" in my mind. There's been a lot of that these days. You should see Leila on another board being finally forced to admit that Guede actually is a nasty character. She at one point refused to call him a drug dealer.... she would only concede he was a "facilitator." I am not making that up.

Oh yes... my hope is that the three-year lawyer DID work in traffic court. Then he'd be able to tell the difference of what's what with Amanda's noise citation back in Seattle. I cannot remember who, but they said that it was proof that Amanda was a criminal prior to arriving in Perugia. However, our three year lawyer could help everyone understand that the citation she got resembled more a traffic ticket than an accusation of serial murder.

Why do these things keep popping up, sometimes years after they've been debunked!?!?!?

All accept the bleach receipts. Despite the cops themselves dropping the bleach receipts as forensically interesting in Nov 2007, another guilter claims to have a copy of them.

He should get them to Florence ASAP because they will be relevant at the new trial. However, every time the topic is brought up he claims that the PerugianLE folks have screwed with his computer.

Thank the Lord above that Machiavelli is an expert in sleep and sleep-deprivation issues. He has not been around here since making a clinical diagnosis of Amanda Knox's sleep patterns, suggesting that she'd gone into interrogation ready and fresh; to do battle with seasoned interrogators and to pull the wool over their eyes.

Machiavelli... maybe that webmaster who has a copy of the bleach receipts also has documentation showing your own bona fides as a sleep clinician. I certainly hope so. It certainly would be embarrassing if you just posted something which showed a propensity to vilify someone and not show ANY restraint whatsoever in doing it.

Personally, I think Amanda Knox is personally responsible for the rise in tooth decay in the Pacific Northwest of the USA.... I know this because the young lady who did my flouride last time at the dentist said she'd read Barbie Nadeau's book, and that "tooth decay" and being a "slut" have a clinical connection.

I did not argue. The young lady had a needle....

one piece of evidence is all that is needed

There is another way to look at it. Throw out all presumptive blood evidence and DNA evidence, and throw out all shoeprints (just for argument's sake). Rudy's bloody handprint alone is enough to convict him. One doesn't need to add it to anything else, because it is so powerful on its own, being stamped in time and in identity. If someone tried to make the case that ILE screwed up that identification also, there would still be Rudy's admission of being there...

Just curious, there's been a lot of discussion about this door and the double-cylinder lock. Was there a glass panel in it or next to it? In the U.S., at least, locks like this are often used with doors where breaking glass could allow a burglar to reach inside and turn the button. Typically the homeowner stashes an extra key near the door where everybody in the house can get to it if they need to. But there is no reason to install such a lock in a door with no glass.

Just wanted to say something about that type of lock. It is more or less a standard type of lock in most of Europe. For example, here in Germany you will find it on virtually every door, with the exception of inside-the-flat doors, but even then the general "style" of the lock is the same (i.e. handle at the top that can be pushed down to open the door, and the locking mechanism at the bottom for the key, just that the inside-ddors usually have the actual lock inside the assembly, instead of a separate cylinder, and are also much less safe).

The thing where the cylinder goes in is the "Einsteckschloß". You can see images of such here on the German Wikipedia. Note that in the first image you see what i referred to as the type often used on inside doors. The next one (for the interior view) is one where you have to put the cylinder in.

Those "Einsteckschlösser" come in various versions, one of them with what they called "Anti-Panik" mechanism. This allows to unlock the thing without a key from the inside only.

As for the cylinder, there are various length. The _standard_ length does not allow to have keys in both sides. If you put a key in on one side, and just slightly rotate it, you are unable to insert the key fully from the other side, effectively locking everyone else out. Only slightly longer cylinders allow for that.

Again, this king of lock combination is bog standard over here, unlike the US, where (from i have seen) completely different types of locks are used.

Greetings,

Chris

Somewhat interesting point from the other side.

If the murder was motivated by a fight over money or some other such thing then the knife from Raf's would never have been transported. If one accepts the DNA work on the knife then one must have the murder premeditated or the infamous prank theory based on a blog comment on an alternative online paper. "Thanks for stopping by" actually contacted the commentator but he refused to provide any names, dates or locations to our favorite moderator. A side note is that he is a dungeons and dragons type of guy (yes I clicked on his name which took me to his MySpace site).

Once again the PGP can't see that dropping things like the knife and Curatolo might help their vain attempts to put together a theory.

If the knife was used then they had to carry it to the cottage and back. No evidence of a means of transport was ever identified. So the theory is that the three of them somehow got together and went to the cottage straight after Popovich and the video ended. Somehow they bumped into Rudi and brought him along for the sex game and prank. The kids then went immediately to the plaza and began arguing.

Then they went down to the cottage after they observed Rudi showing which means Meredith had been home for at least 1/2 an hour doing what? By now at least 3 hours or as many as 4 had transpired from the start of her pizza meal. Is it possible that digestion hadn't started? Yes, but not likely.

They then rush down to the cottage without Curatolo noticing and they join in, with the knife that they brought and Curatolo didn't notice the bag it was in. Then they murder her but that doesn't fit with Nara who is crucial for the multiple killer theory.

They are probably blitzed on heavy drugs that somehow the ILE didn't test for or messed up. We here must admit that they could have messed up the tests.

They have to return to the plaza before the car breaks down and can't return until 11:15, in the meantime they would have blood on them and would be pretty amped up.

There a start for the scenario - it's tough.

I don't see how they can drop the knife. If they do, they concede that the DNA testing was a pile of dingoes kidneys, and their entire case falls to bits.

Rolfe.

I also think that. The knife is the tiger's tail they can't let go of. It's not just that the case collapses but that defence turns to attack.

ETA the knife was in a plastic bag inside Raf's jacket.

I'd never looked at it that way.

Still - it just goes to prove. The knife was collected as a one-off, collected in Raffaele's presence, to demonstrate to him that they were not kidding, that they were going to throw the whole shooting match at him, too, if he did not cooperate.... the only real difference between Raffaele and Patrick is that Patrick did see the wisdom, ecentually, in cooperating.

Well, ok, Sollecito only had Amanda Knox as his alibi, and considering that the PLE were intent on throwing the whole shooting match at her no matter what... perhaps they would have dropped the knife...

... except that without THAT knife, then there is really NOTHING tying Knox to the crime at all.... there's already nothing about Knox in the murder room itself.

So drop this knife - what do they have on Amanda? Drop this knife and then one of two tenuous links to Raffaele disappears... and worse:

Raffaele himself can get the idea that this piece of bogus evidence, collected originally with the sole goal of scaring the crap out of him and never (then) meaning for it to have to bear the burder of being introduced at trial....

..... itself becomes less scary. In fact, Raffaele might get the idea that his stubbornness in not withdrawing an alibi for Amanda might actually be FOR something good for him.

What remains for Raffaele without that knife. A single Y-Haplotype that was so untestable that it could either reveal whose it was, or what it was (an not both).... and then it's gone. And that's before considering the circumstances under which it was collected.

To keep or not to keep. That is the question. If the Florence trial is decided on the evidence, then the students have no worries. If it is decided on other things, then the decision is wide open.

More of discussing anything but the actual case:

All three killers exhibited high-risk behaviour prior to the assault. Sollecito collected animal porn. Knox hosted wild parties. Guede allegedly peddled drugs in Perugia.

Let's see, Knox was given a noise ticket once, Raf had some porn on his computer ar a younger age and Rudi was "alleged" to peddle drugs and these are "high" risk behaviors.

They go gone to once again bring up the "alleged" ski mask prank that had no basis other than a comment on a blog.

Except if you carry out a brutal 'prank / hazing', with knives and sexual assault, on the night of 1 November, and leave the victim alive, you're arrested no later than 2 November and you've gone and added water to your Acme Instant Boulder Pellet while holding it over your own head. Golden Future kaput. (The alleged 'ski mask prank' in Seattle just consisted of masked men enlisted by Knox bursting into her female housemate's room -- and then going, 'Surprise!' or whatever. Nasty, very, but this particular 'hazing' at 7 Pergola was, even at the minimum, a lot worse than that, and Knox was not in her hometown comfort zone, even if her shag-of-the-week assured her that his family was rich and 'connected' and could make the cops go away.)

ETA - more breaking news - Then there is all the other aspects of his life that are red flags. A mother that committed suicide, a family that is associated with organized crime, the ridiculous degree of helicopter patenting his dad demonstrates, Raffaele's sexual inexperience, braggadocious drug consumption, previous consequence free issues with the law, completely directionless in life and dependent on his family for everything, etc.

Lastly, and quite important is that there is very strong evidence that Sollecito has stabbed a girl before Meredith and that it was all covered up so he escaped consequence free from that as well.

This is good stuff. There's surely a book in there somewhere.
