The state of FL v. George Zimmerman

Martin's school records and history of fighting can be mentioned outside of opening statements.

Just a minor clarification: The judge did not explicitly rule that this could be mentioned during the trial, but rather that it could not be mentioned during opening statements, and that any mention during the trial would be determined on a case-by-case basis, and only after certain legal hurdles were cleared.

I predict those hurdles will not be cleared.

Has no one mentioned yet that the judge denied the defense request for more time to prepare for the trial?

Jury selection begins in 12 days.

Exactly.

She said that they will have to convince her that it is relevant.

I'll let everyone guess how hard it will be to convince her.

Minutes from May 28 Docket Sounding - Court minutes from hearing on motions.

Media Companies' Brief on Electronic Coverage of Jurors - The media companies who intervened to object to a gag order and anonymous jury have removed their objection to an order prohibiting photography of jury members provided that prohibition applies only to the court setting and expires after trial.

05/28/2013 SUDI DEFENDANT'S 4TH SUPPLEMENTAL DISCOVERY - Zimmerman has filed a 4th Supplemental Discovery Exhibit with the court. Since this pleading has not appeared on the GZ Legal Case site, I'm assuming the discovery exhibit consists of protected information.

There is a G-d. Finally, George is getting some justice. Page 3 "Crump is not an opposing lawyer" Unamious decision by the 3 Appeal Judges. Maybe now we can get some decent ruling by Nelson. Heads Up, 5th Appellate, more hot potatoes are coming your way.

Judge Nelson's decisions are based on case law, not personal opinion.
Did you miss the part where the entire appellate court panel said Nelson erred? Meaning Nelson's ruling was not based on the law, but on an incorrect interpretation of it?

Not a single dissent.

This is regarding the defense and their desire to depose Crump. Yes, they can do it but scope is very limited. So possibly a win for both the defense and Crump.

This has nothing to do with the rulings from the hearing on the 28th. And I will laugh my ass off when O'Mara is sanctioned for lying about the video he was so sure would break this case wide open. The fact that they knew about and still moved forward with false allegations won't help them in the future.

ETA: from the ruling:

In concluding that the trial court erred in denying Zimmerman an opportunity to depose Crump, we caution that any deposition of Crump is to be limited to inquiry of circumstances surrounding the interview of Witness 8 and the contents of such interview. Defense counsel may not inquire into Crump's mental impressions regarding Witness 8, nor may counsel inquire as to the reasons why Crump conducted the interview in the manner in which he did. Additionally, we believe the work product privilege precludes defense counsel from making inquiry as to the reason(s) Crump attempted to locate Witness 8 and the methods employed to do so.

The deposition contemplated by our opinion should be relatively short and straight forward. We are confident that the trial judge will be able to take the steps necessary to ensure the deposition is limited to the subject areas described above.

The DCA appears to express confidence in Judge Nelson.

Nice spin, I guess it's "limited" to what they wanted to depose him about in the first place.

Demonstrably untrue:
Additionally, based on public statements Mr. Crump has made, counsel has learned Mr. Crump possesses information relevant to this case on matters strictly not related to his involvement with, or interview of Witness 8 - information that is not privileged, or for which the privilege has been waived.

The scope of the defense's deposition of Crump has been limited accordingly:
... any deposition of Crump is to be limited to the inquiry of circumstances surrounding the interview of Witness 8 and the contents of such interview.

So the defense will not be allowed to question Crump "on matters strictly not related to his involvement with, or interview of Witness 8".

If this were true, then why is the defense trying to preclude ANY experts from testifying? If they had an expert in their pocket or if the state's witness helped them, why are they in panic mode?

Have you considered the possibility that the defense is actually being ethical, and legitimately believes this science isn't up to the task of comparing a scream to speech?

They do have voices, since they invited George to replicate his own screams. It's not the state's fault that his wimpy yelps sound nothing like the screams heard on tape, is it?

The police instructed him on what to do, and unfortunately their instructions were very poor. Nonetheless, in this video from Ed Primeau (whom I think is a joke, and whose "In my mind's eye" nonsense is firmly in woo territory) demonstrates clearly that the screams were from Zimmerman, using those flawed police exemplars.

Primeau's methodology of just "listening" and using the bogus early media narrative as his "mind's eye" starting point, are clearly wildly flawed and subject to human error, but none of that is used in this video he uploaded very recently. In this video he merely combines the exemplars and the screams into one file, alternating between the two. In that, his methodology is generic and not disputable.

And again, in this video it is completely clear that the screams are from Zimmerman. I defy anyone to dispute that, and I'll go so far as to say the only basis for disputing that which I can imagine anyone having is simply an emotional clinging to a fact-deficient early narrative, and personal pride.

Here's the video

If anything related to voice experts comes in at trial, I think Primeau should be compelled to play this same audio.

ETA: Just to clarify, in case anyone is confused about what exactly I'm saying re: voice analysis... in case it sounds like I'm having it both ways, saying the science isn't up to the comparison on one hand, and saying this audio makes it clear that it's Zimmerman on the other, let me attempt to explain what I mean.

I'm saying that, whatever abilities voice recognition and comparison may have under more normal circumstances, comparing two speech samples to one another (and I can't speak to it's abilities in that regard but I suspect they are much more firmly established) I do not think that the various pieces of software which attempt to make some sort of automated comparison were applicable due to the unique situation here, comparing a scream to speech.

Even more importantly, I do not think woo methodology like "mind's eye" and "this shall be" from people like Primeau and Reich are valid, at all. I think that human error and confirmation bias are HUGE problems when you get into methodology like that. I think coming to a conclusion that it's not Zimmerman when doing a sort of comparison you've never attempted before, with what appears to be fairly untested software which was released within days of those findings, all in the absence of having a sample from Trayvon... as Tom Owen did, is wildly unethical and irresponsible and unprofessional.

I believe considerations like increasing personal notoriety and selling more software, and just getting on TV and raising the profile of a small, fairly unknown science, was a huge corrupting factor in a lot of these findings. The proper thing for most of these "experts" to say was "I'm sorry, comparison of a scream to speech is simply not within the scope of what I can do, particularly in the absence of a sample from the other party present that night."

I believe the extremely tainted narrative present in the media at that time impacted those findings of Tom Owen, Ed Primeau, etc... just like it impacted people like Mary Cutcher, John, and the "larger person" witness. These gentlemen are only human, and I don't for a second believe they would have ever released the same findings if the injury photos of Zimmerman had been available at that time.

As for what I'm saying about this audio being clear, does that seem at odds with what I just said about the deficiencies of this science? I'm sure it does, but the key difference is that we have a lot more information (injuries, Trayvon's size, what his father said to police, what his brother said in an interview, what neighbors said, etc...) and this is the first time I've seen the exemplar paired with the screams in this way. The totality of all evidence and information in this case which is available now, combined with this new assembly of the audio... I believe leaves no doubt about who was screaming.

Personally, though, I don't believe there has been doubt about that in any reasonable mind since the injury photos of Zimmerman were released.

Zimmerman has filed a Notice of Hearing for June 6, 2013. The hearing will be Thursday at 9:00 AM EDT.

Motions to be heard:

Defendant's Motion for Sanctions Against State Attorney's Office for Discovery Violations and Request for Judicial Inquiry - Continuation of hearing from May. Zimmerman asserts that the state failed to disclose reports regarding the contents of Martin's phone.

Frye Hearing - The court will hear testimony regarding the various voice and speech identification methodologies and decide if these test are based on sound (no pun intended) scientific principles and have gained wide acceptance in their respective fields.

Defendant's Sealed Confidential Motion to Maintain Anonymity and Confidentiality of Certain Witnesses - A sealed motion by Zimmerman that will almost certainly be heard in camera.

State's Motion to Compel Discovery - This motion has not yet been released.

Related to the trial: does anyone have any guesses on how long the actual trial will take?

Several posts have been moved to AAH as they did not meet the limited scope of this thread (which was created as an exception to the related [moderated] thread, and with specific and strict parameters), and were instead more suited to the related and currently [moderated] thread. Some or most of these posts might have been perfectly fine for the other thread, but do not use this thread as a means to avoid the [moderated] status of the other thread.

Stuff that jumps out at me from that discovery packet:

-Custodian of records, Sean Hannity show (FOX News)

(The Hannity interview is where some of the most damaging evidence we have seen comes from. Ironically direct from Z's own mouth, with his lawyer sitting there to boot.)

-Kokopelli's Gym information & records (where Defendant trained)

-Phone records from the night in question from both Shellie and Robert Jr
