It appears to be mutual and I can't determine if there was an actual restraining order or not. The articles mention that it was filed, but not if it was accepted (or whatever the legal term is). Everything else is just accusations, none of which would preclude him from a conceal-to-carry.

A restraining order is not a disqualifier.

A conviction or withhold adjudication of guilt is.

Wait, wait, wait. The "stalking" was premeditated based on the 911 call. The 911 call doesn't show that the assault was premeditated.

Can they just look through Martin's personal items without a warrant right there at the scene?

Also, they spent a while trying to revive him.

Was his phone right with him, or did it possibly take them time to find it?

No, no warrant necessary. He was pronounced dead at the scene IIRC.

I wouldn't imagine his phone would have been very far from him, but it's certainly plausible. And I don't know about the condition of the phone. However, all it would take was a call to the carrier and ask for the last 24hrs of calls. Most companies will give that information to a LEO, especially to identify a deceased victim.

I see what you're saying, but the conclusion is not necessarily correct. I may say I'm going to make sure that you don't get away, but that doesn't mean I now have the upper hand against you. In our confrontation, if you overpower me and start beating my head into the cement, then fear for life is right back in the game.

Although, I'm not certain what that has to do with the assault being "premeditated".

He was attempting to block Martin's retreat, even though the lunatic had no way of knowing where Martin was headed.

Also - legal rights don't mean much if your are not alive to exercise them. :(

My point is that the only person we KNOW to have had the right, under SYG, to use lethal force was Martin. Makes fatboy look guilty, in my opinion.
 
It's interesting where they got that information since no news outlet has been able to reach Zimmerman and that is not the account he gave to police. Zimmerman admits to following him and said nothing about checking road signs.

The problem is, that is exactly the account, per the Sanford Police.

Unless I am of course missing something.

A self-important twit who thinks he knows what looks right or not in his neighborhood has to get out of the vehicle to know where he is? Doesn't make sense.

If the idiot was trailing Martin, how did he get attacked from behind? He didn't look around before he got out of the vehicle? You really have to be one stupid twit not to look around before dismounting, and he prided himself on knowing how to watch suspects. How many places could Martin have hidden on the street?

It does if Martin was actually a ninja. Then a lot of questions get answered . . . except how Zimmerman survived. Oh yeah, he had a gun.

Fatso could be said to have provoked Martin into attacking him by trying to corner him. Martin was within his legal rights.
If you really want to argue that then you have the bizarre situation where both were within their legal rights, and Zimmerman walks.

No. The lunatic was following Martin for no apparent reason. He put Martin in a state of fear for his life. He was wrong and should have wound up dead.
 
Far as I know it was in his interview with the narcotics officer. I'll see if I can track down where I read that.

He put Martin in a state of fear for his life. He was wrong and should have wound up dead.

He knew cops were on the way. He had no need to confront Martin. He just wanted to.

He had no probable cause to confront Martin.

Martin would have had probable cause to smoke his crazy ass.
