I was wondering if the High Court would try that one on. There was never a fuss about sending refugees to Nauru, to a situation that was much worse than Malaysia. In Malaysia they could seek work, not be locked up, and not be on an isolated atoll in the middle of the ocean. Now all of a sudden they wake up and tell us that you can't do that to refugees. By claiming so, they also effectively condemn the sending of refugees anywhere else but Australia. The defence for Malaysia was, of course, that no one stopped anyone being sent to Nauru, despite legal attempts back then. The lawyer who filed the claim was surprised it was passed by the court.

Unless the law is changed, of course. Who is going to be able to pass that? Will make for interesting politics.

Under the judgement, Nauru is not a legitimate destination for asylum seekers,

The Court held that, under s 198A of the Migration Act 1958 (Cth), the Minister cannot validly
declare a country (as a country to which asylum seekers can be taken for processing) unless that
country is legally bound to meet three criteria. The country must be legally bound by international
law or its own domestic law to: provide access for asylum seekers to effective procedures for
assessing their need for protection; provide protection for asylum seekers pending determination of
their refugee status; and provide protection for persons given refugee status pending their voluntary
return to their country of origin or their resettlement in another country. In addition to these
criteria, the Migration Act requires that the country meet certain human rights standards in
providing that protection.

His is close to the easiest gig in the land at the moment. Labor keeps shooting itself in the foot while trying to keep up with his big lead in the race - the gap just gets wider and wider and the public know they've backed a dud.

Why would I suffer? This is the best political time I can ever remember. So much going on: So many idiots that voted Labor or green, so much chaos, so much confusion, so much incompetence, so much drama, so many scandals, so may allegations.

And I have every intention of bringing you all the news I can find. I would hate for you all to have your collective heads up your Ageholes that would shield your eyes and ears from nasty news. My duty is clear.

That should see the Labor brand completely effed for the next decade or so. The longer she is in power, the better off the country will be long term.

BTW LK. You may not have noticed but I read The Age, The Drum, ABC and Herald Sun online and often provide info from each. These sources often give me links to other papers such as the Australian, Daily telegraph etc.
I fail to see how I am narrowly read (which was your inference), I think the collective shoes are on the other foot, don't you?

I said earlier - it is just a reckoning about Gillard. The government cannot allow her to lead them the utter and abject destruction in two years time - they must have greater respect for themselves and the Labor party and brand, surely?

It is clear to me that Gillard was a very very good second, but an appalling leader. In fact when she took Kevin's job I was quietly hopeful that she would fix the leadership issues that had plagued Rudd and set the Labor party back on track. Sadly she turned out to be even worse - and by quite a lot in my estimation.

I heard an analogy the other day that I quite liked: She is like the best teacher at the school, everyone likes her and she does a great job. She then gets promoted to the principals position but her teaching skills do not transfer at all well nor easily into the leadership position. As a result she is a very bad principal.

In this case we have an appalling principal and the school board will need to act and soon. I am guessing six weeks or so which allows caucus to reconvene in Canberra, the faceless men to get to work etc etc.

I also reckon she will be forced to resign, she won't be knifed a la Kevin.

FORMER Labor power broker Graham Richardson believes Julia Gillard will be finished as PM before her term is up.

Mr Richardson said there was no way Ms Gillard could fix the problems with her leadership.

"There’s no way she can turn this around, you’ve got to say it gets worse for her every day, never gets better, just gets worse,”


Richo reckons the government will be finished in about 10 months. Cioncidentally this is around the time that Gillard must provide pokie reform to Wilkie.

“I’d say it’s probably got ten months or so to run but I can’t see it running much longer than that.”


Alexander Downer sees her falling within months.

Former Howard Government minister Alexander Downer predicted Julia Gillard was unlikely to remain as Prime Minister and could be gone before the end of the year.

“It’s very very hard to know when it will happen, this will have an enormous impact on the psyche of the Labor party which is already worried about Julia Gillard, they are clearly of the view…that she has turned out to be completely incompetent as a Prime Minister
