I was wondering if the High Court would try that one on. There was never a fuss about sending refugees to Nauru, to a situation that was much worse than Malaysia. In Malaysia they could seek work, not be locked up, and not be on an isolated atoll in the middle of the ocean. Now all of a sudden they wake up and tell us that you can't do that to refugees. By claiming so, they also effectively condemn the sending of refugees anywhere else but Australia. The defence for Malaysia was, of course, that no one stopped anyone being sent to Nauru, despite legal attempts back then. The lawyer who filed the claim was surprised it was passed by the court.
Unless the law is changed, of course. Who is going to be able to pass that? Will make for interesting politics.
