This case is about a victim, Meredith Kercher, who was brutally murdered, and the three persons who have been convicted of killing her.

Instead of scrutinising some of the investigations' initial scenarios or theories, I would have thought that most people would be interested in scrutinising the actual evidence which has convicted Knox, Guede and Sollecito.

You could have replaced Mignini at any point in the trial, and still have gotten the same result, with the same people convicted, with the same reasoning presented in the Massei report.

No, I disagree. Amanda, Meredith, Raffaele, Rudy, and Patrick were the ones interchangable. For this simple interrupted break-in turned tragedy to become a bizarre conspiracy between three people who barely knew each other to murder a girl for absolutely no or ridiculous reasons you needed the mind and talents of Mignini. He came up with a preposterous claim, presented scant and contrived evidence, and the eventual reasoning of the Massei report was ludicrous. The fact he got a conviction in the first trial is interesting, and how he accomplished that is fascinating, as are the elements out of his control that contributed to that 'perfect storm.'

You can find people very much like Amanda, Meredith, Raffaele, Patrick and Rudy in any college town, however Mignini and his history is relatively unique, and a telling point regarding his necessity to this story.

Haul himself up and put his knee directly on the window ledge. What do you think he's supposed to be doing with the wall? Why does he need to touch the wall?

I think he probably climbed onto the concrete planter, grabbed the edge of the roof, and swung across to the window ledge, in which case he would be crouching rather than pulling himself up.
 
Mignini will never be out of the picture, because that fat-faced wino pervert is almost wholly responsible for Amanda's wrongful arrest, imprisonment, conviction and the tragic loss of years of her life.
No, the only person responsible for all of that is Amanda herself.

And where do you get off referring to Mignini as a 'wino pervert'? Do you have ANY evidence to support that claim? I thought not.

I meant the wall in between the top part of the lower grating and the upper window by which Rudy gained entry.
 
Isn't he involved in the appeal?

At any rate in my opinion this story is mostly about him. He's the one that developed the ridiculous theory and sold it to some, thus any discussion of what happened in this case is likely to end up scrutinizing him.

The others, aren't they adults? Aren't they responsible for what they decide? And for what they buy?

Umm ... Amanda and Rudy and Raffaele were all brought to trial on the basis of the same body of evidence which resulted from the same investigation which ended at the same moment for all of them.

It just so happened that Rudy's legal strategy led him to an abbreviated trial, while Amanda and Raffaele opted for the full-blown trial. Otherwise, all three suspects would have been together for the whole long trial.

It's a common FOAKer talking point to suggest that Rudy was somehow found guilty first and that Amanda and Raffaele were brought to trial later. That in fact is not true.

The case we have been discussing is about whether Amanda and Raffaele are being persecuted, based on something other than their participation in the crime.

If Mignini had been replaced on November 4th, there would have been no trial.

Mignini was not present on the night of 5 November 2007 until after Amanda had admitted her presence in the cottage on the night of the murder.

Ahh, so there's evidence he touched the lower part of the wall?

In any case, how does it step on the top part of the grating without touching anything above it?

Unfortunately, there are many examples of mindless murder in this wild, weird world we live in, including many cases between persons who barely know each other. Mignini didn't have to invent anything.

He stands on the top level of the security grating of the window below. As such, a tall guy like Rudy is practically in the upper window already. He breaks the window, and hauls himself in, not touching the wall barely at all in the process.

Your are ignoring Nadeau's report that Mignini wanted to reintroduce the satanic element into his closing remarks. Comodi demurred, but that did not stop Mignini from doing something almost as ridiculous, which was to manufacture words to put into Amanda's mouth utterly without basis in evidence, as Scott Greenfield noted.

That scenario would be as difficult as climbing up, as he would have to drop down on to a small ledge with nothing to hold on to if he fell back.
