No, it isn't. And even Frank doesn't say so there. 'Suggests' is opinion and subjective and does not constitute a fact. How can you date a stain? How can you show it wasn't left the night before or the night before that?

I ask you again to apply your logic to the luminol prints. There is no way of dating those stains.

There is a way of dating the possible semen stain. Rudy may have stepped in it on the pillow. We won't know until it is tested. Using Crimescope, the substance was detected smeared in one of Rudy's shoe prints. See the photo below.

Test the substance and see what it is. Raffaele's lawyers are asking for tests in their appeal. It should be granted.

Hello Fulcanelli, given your extensive knowledge of this case and the Italian legal system I think you can help clear something up for me.
When exactly did RS/AK become suspects and when were they informed of their right to have an attorney present during any further questioning?

At the end of their questioning. Or to be more precise, the police made them suspects and then ended their questioning.

She was "read her rights" at 1:45am when the interview was concluded due to her implicating herself as an accomplice (who let Patrick in the cottage, who stood by in the kitchen while Meredith was being attacked?) to the murder.

You're right. My slip-up on the time.

Although it doesn't lessen my argument that she should have been read her rights before things escalated up to her making the 1.45am statement... (yes, I know you and others might argue that the "confession/accusation" came more-or-less spontaneously out of a clear blue sky, in the midst of an anodyne conversation about the text message. But I simply disagree that this would be possible - I believe there had to be prior police accusations (at least) which prompted the breakdown.)

If the stain on the pillow is semen and it belongs to Rudy, it casts even more doubt on the prosecution's case. It also shows complete negligence in the investigation of the crime scene.

London John said:
Access to a lawyer after being arrested or brought to a police-station or prison

Which is the key phrase here and also is the title of your whole post. They weren't under arrest.

Oh, come on!

errr....come on what?

It's a near-certainty that if he had put his hands in the air when challenged by the police in that tube carriage, he would not have been essentially executed by SO19 police officers who were looking for action in a city that was in mild panic, and who had been led to believe that de Menezes had definitely been ID'd as a potential suicide bomber.....

Why would he 'want' to? It's clear he didn't care. But so, if you state it as fact that there was no blood on his right shoe, then how is that?

All of the prints on the floor match his left shoe. That would mean that he had no blood on his right shoe.

How is that? Because he stepped in blood with his left foot and not his right foot. this is not really hard to understand.

You know you were completely wrong with regard to the shoe prints and now you are asking questions like you are a child.

Man up, admit you had no clue about the shoe prints and let's move on.

The translation is available?

Well, Bruce (as he declared) and his people are translating it are they not? In which case, how can they be completely oblivious to its content? He is not your average poster, but claims direct access to source content. My complaint, which is valid, is that clearly he's not read that source content he claims to possess....or, he's deliberately avoiding it.

And I ask again...'when' else was blood all over the cottage in order for people to leave those stains?

And the word 'if' is big and vast and can be anything you want it to be. The one thing it isn't, is an argument.

You're ignoring all the partials then?

Once again, there is no proof that the stains were made in blood. In fact the stains were tested and the tests were negative.

I have received some new information regarding the cleaning supplies in the cottage. This will come up on appeal also. You appear to be incorrect about the cleaning supplies also.

Does that surprise anyone?

Beats me if they are translating it or not. I believe he told me he would be happy to give me a translated (not by google) report if he had one. I think I remember asking you the same question.

In the hall? Please show me the photographs of those partial prints you speak of.

The prints in the hall made by Rudy's left foot are all partial prints. There are no prints from his right shoe.

Great. So you acknowledge that one foot can step in blood and the other be clean of it? No more 'claims' of Amanda and Raffaele needing to levitate out of the room then? Fantastic...glad we got that sorted.

Massei lists a good many partials...in excess of 30 if I recall right (I might be wrong on the exact figure, but the number's high).
