That's just the wording of the petition. You can put anything you want in a petition. It's a form you get from the city and you can put in four pages of "marshmallow, marshmallow, marshmallow, marshmallow". It doesn't mean that what's in the petition is backed by code.
From the petition (bolding mine):
5. The Commission shall have the power to place witnesses under oath, issue subpoenas for documents and testimony, take and record testimony, and to apply to the appropriate federal, state, out-of-state or foreign courts for the issuance of subpoenas, Letters Rogatory, or Applications for Mutual Assistance, for service upon persons, corporations, agencies or other entities beyond the subpoena power granted to the Commission.

As I understand- if the referendum passes, it will modify the city charter of NYC. As a matter of local law, they will have subpoena power.
Are you referring to individual subpoenas being rejected? How do you know this?
What I am talking about, is that any suggestion/request/proposition, that if successful would grant the group, blanket subpoena power, is dead at the gate. No judge, or body/institution, is going to grant a group of unappointed, and likelty unqualified individuals the ability to subpoena people at will...just not going to happen. The 9/11 commission was a CONGRESS appointed commission of qualified individuals.
Do you REALLY think some judge etc... is simply going to allow a group of "whatevers" to come along, and start subpoenaing Bush, Cheney, Rove, etc...?
really????

Another little tidbit I found. The NYCCAN petition says that Ralph Schoenman, political scientist, would be one of the commissioners. The same Ralph Schoenman who wrote "The Hidden History of Zionism" and is a notorious anti-Semite. That'll sit well in New York. [/sarcasm]
Because he is.How do you know he is a notorious anti-Semite?

If they send me a subpoena, I can send it back to them with a big FU on the front, and they cannot do SQUAT about it. It would have to come from a federal judge.
Where are you getting this information from? If I'm not mistaken, you would be subpoenaed to a court in the state you currently live in to give a deposition (or whatever else, based on the subpoena), but that's only if your state court agrees to do it.
Like I told you before, I don't know for sure.. and I'm pretty sure you don't, either.
How do you know he is a notorious anti-Semite? Are you claiming that only an anti-Semite could write that book, or do you have some other reason to believe that?

There are other problems with the petition, of course, not least of which are jurisdictional and constitutional problems that will preclude the proposed group from obtaining any subpoena power whatsoever, but I first want to know, hypothetically speaking, what reason you have to believe that any subpoena power conferred by the City Council of NYC would have any force or effect on anyone outside of NYC.What makes you think that any subpoena power that can be granted pursuant to a NYC local law would have any force or effect upon anyone located anywhere other than in NYC?
Yes.In other words, upon what specific provisions of the governing legislation do the petition-drafters rely in order to bring the requested relief within the purview of City Council's limited authority to adopt a local law?
