I have no idea if you can be legally prosecuted for denying the existence of the Holocaust in Germany (I bet you will not for doing so in Italy or Japan).

It has everything to do with freedom of speech. Words and words alone got David Irving 3 years in an Austrian jail. While Irving is a despicable person jailing him for speech is a magnitude more despicable. From that article:

None of those things will get you in trouble in the US, where free speech is actually valued and enshrined in the Constitution.
