The Republicans maintain a series of lies that the congressional delegation "stormed" the facility, that they "body slammed" an ICE officer, and that they "holed up" in a guard shack after entry. Literally none of that is true, and there is plenty of video of the incident.

The mayor is a different story, as he had no right to enter. He entered, was stopped by ICE officers, and told to leave. He did so peacefully, but was arrested anyway.

If he did so peacefully he would not have been arrested. Is there any bodycam footage?

Police memory can be used as evidence for probable cause.

Conduct: Safety, security, and good order are always primary considerations in a detention facility, and visitors must be properly identified and attired. All visitors are subject to search upon entering the facility and at any other time during the tour/visit.

All visitors must present a valid, verifiable government-issued identification card to enter an ICE detention facility. To preclude potential delays, Members should be prepared to show valid identification identifying him/her as a Member of Congress. Congressional staff should be prepared to show valid congressional identification issued by either the House or Senate Sergeant at Arms Identification Office. Identification will be checked prior to entering the facility. If the facility is unable to validate the identity of a visitor (e.g., the individual is not in possession of valid congressional identification), that individual will not be allowed to enter the facility.

Recording Devices: For the safety, security, and order of the facility, and to protect the privacy rights of those in custody (to include the right to not be photographed or recorded without consent), as well as visitors and the employees, contractors, and volunteers who work in these facilities, no electronic recording devices or picture taking is permitted inside ICE detention facilities. Before attempting to enter any ICE detention facility, all visitors should leave cell phones and other electronics in their vehicle.

my understanding is that this was not a federal facility. It was a private facility. It had to be approved first by the city, and it may be that city authorities have a right to inspect. Once approved as a detention facility they could then contract to house detainees under contract to ICE. The contract with Ice may include a right for inspection by members of the house and staff.

He was charged with misdemeanor trespassing under New Jersey state law. Under 18 U.S.C. § 13, violations of state law committed upon federal property can be charged in federal court. The federal trespassing statute has a more stringent requirement for intent, and so was not charged here. Since the charge was brought by acting U.S. Attorney Alina Habba—probably one of the least competent attorneys I can name—that should tell you how much water the charges are likely to hold.

Possibly. The City of Newark has sued the private operator claiming it completed its renovation of the Delaney Hall facility without proper permits and certificates. The company claims in response that it does have proper certification and has started housing detainees there in defiance of the suit. I'm not sure what rights city officials have to enter and inspect while the suit is pending.

Delaney Hall is owned by a private company. As such it is not federal property for land-ownership purposes. However, private parties that carry out federal functions under contract fall under some laws governing the activity of the agencies themselves, depending on how the law is worded. There doesn't seem to be any question that the owners of Delaney Hall have a contract with ICE to operate as a detention facility. In that respect, the access policy in statute is enforceable against the private contractor as it would be against the agency itself. The interesting point of law is whether the City of Newark's dispute includes ICE by virtue of the contract, or whether it is solely with the private owner.

The Department of Homeland Security announced on Monday it had stripped legal protections for thousands of Afghans in the U.S., saying that the security and economic situation in Afghanistan no longer justified granting them temporary protected status, or TPS.

“We’ve reviewed the conditions in Afghanistan with our interagency partners, and they do not meet the requirements for a TPS designation,” Homeland Security Secretary Kristi Noem said in a statement.

“Afghanistan has had an improved security situation, and its stabilizing economy no longer” prevents Afghans from returning to their home country, she said.
