No, that's what ICE said she wanted. Since there was no due process, no access to counsel or family members, there was no challenge to that charge or statement until it was too late. Minors are still citizens, and the family's wish was for the child to remain in the U.S.
Look at all those amendments in the Bill of Rights dealing with those accused and convicted of crimes! If you read the Declaration of Independence (which Pres. Trump clearly hasn't), you read that one of the gripes of the colonists was being accused of crimes and then shipped off to someplace they'd never been in order to be tried for them. Maybe the whole "due process" thing was something those colonists were a little salty about and wanted to make sure happened.
