They didn't say that they put cover sheets on documents. They said they used cover sheets as placeholders for documents removed from the boxes.

Note: The classification is included on each page of a classified document.

It's nonsensical to try to push the angle that the photos are the only evidence that they were well marked when every paragraph should generally be marked, as well as all the rest of the markings.

Again, though, Trump publicly claiming that they were his, being caught on tape saying that stuff he took was secret, highly confidential information, and the like make that general line of argument even more nonsensical. Trump knew. There's no honest question or dispute to be had about that.

Those photos are the only publicly available information which suggests that classified markings on documents were obvious, and they are responsible for the public impression that there's no way Trump didn't know they were classified. So why wouldn't I conclude that's what he was referring to?

Huh? He admits they were classified lol. He just says he can do whatever the **** he wants cause he is (not was, still is in his warped mind) El Presidente.
 
Yeah, it's such a stretch to think that when the prosecutor says they put cover sheets on documents, and they show pictures of cover sheets on documents, they might be pictures of the cover sheets they put on documents. It's a completely crazy idea.

No, no, he’s innocent. So innocent in fact, he doesn’t even know it himself!
 
As always, the FBI is the righteous defender of America if it goes against Commies/Gays/Socialists/Unionists/Minorities and is above all reproach.

And it is the black-booted hand of the tyrannical government when it acts against anyone on the Right and needs to be abolished.

There's a perfectly innocent explanation: they were there for easy review by the Russian hooker Putin supplied to urinate on him. She just can't go unless she has reading material. See? Perfectly innocent stuff.

In all fairness, if the FBI searched my bedroom I'm sure they'd come with a lot of stuff I don't remember misplacing. But you won't find classified material in my bedroom because I treat classified material universally differently than, say, my weightlifting gloves.

Skimming the actual brief, it appears the sticky wicket is that the new discoveries can't be excused with an, "Oops, I forgot about those," such as was the case when Biden turned over classified documents he wasn't supposed to have. Trump is under notice that anything bearing classification markings is not to be retained by him. Hence it's plausible to conclude that Trump intended to retain the documents found in his bedroom, in violation of the court's order. Thus this can result in the grand jury amending their indictment to include additional charges.

Incidentally, when I was working at the Lawrence Livermore National Labs, I was lamenting that I had misplaced my sunglasses. Cars are spot-checked and searched thoroughly by the security staff upon entering or leaving the installation. I have never seen such a thorough vehicle search before—and they found my sunglasses.
 
considering he intended to keep all the other documents stacked in his shower in violation of a court order, i think it's fair to count the ones in the bedroom with them.
 
Informally we can certainly say that if Trump intended to keep the bathroom documents he also clearly intended to keep the bedroom documents. But the way the law works, each document is a separate count. And each count must be supported individually by facts and a legal theory. So we have to go through the exercise in each case of determining Trump's intent. The court has to be able to say it considered the possibility that Trump didn't know they were there.
 
yeah, that's fine. there's a pretty big difference between things i am comfortable stating as a fact than what would be required under some legal theory.
 
If the classified docs had been found in Melania's bedroom, then it would be perfectly believable that Donnie didn't know they were there. :D
 
I hate sounding like a pessimist. It's not my nature generally. But as long as Judge Cannon is running the documents charges, this is unlikely to ever get to trial.
