Cont: Rioters storm and occupy the US Capitol - part 2

Re: First felony sentencing for the Jan6 terrorists
Disappointing. Less than half of what prosecutors were looking for.

And yes, he was 'non-violent', and cooperative, etc., but to me, that's already been factored in, by the fact that prosecutors were looking for only 18 months on one charge, rather than continuing with all the other charges he was facing (which would have resulted in years of prison.)
would guess that we're seeing the most lenient sentences up front. Those with uncomplicated cases that cooperated and plead out quickly are first down the hopper.
Yes, I agree, the uncomplicated cases with the most lenient sentencing will be first. But I think its still a valid concern if the sentences are too lenient.
I wouldn't discount the severity of being a convicted felon in our absurdly punitive society. This conviction is going to haunt this guy for a long, long time.
Yes, that is a small bit of sunshine in this. I hope he likes adding 'convicted felon' to his resume.

Yeah, they're gonna clear out the easy cases quickly.

There should be a federal law against "Being A Complete ******* Dumbass." With a minimum 5 year prison sentence.

This would not help with the overcrowded prisons though.

Well they could make room by releasing everyone who's in there for minor crimes such as possession of personal amounts of illegal drugs, jaywalking, third-degree assault with a stoat*, and finking!

* But only if the stoat was unharmed.

Maybe they can get "Sherrif Joe" Arpaio to set up one of his desert prison camps for the Jan6 terrorists.

Or does that only work for non-caucasian defendants?

And those pleading guilty which usually earns favor with the judge.

The vast majority of these people are going to plead guilty, because that's what most people do generally and most of these CHUDs are facing overwhelming evidence of guilt.

He got the judge's sympathy when he said he worked as a volunteer in a food bank.

That must have been why he was carrying rope, in case he had to secure crates of food for the homeless he encountered while trashing the Capitol.

It would, but they would still be overcrowded.

Remember, one of the earlier defendants who has been sentenced initially expressed remorse, but then returned to the "justified" rhetoric.

Prosecutors always ask for more then then expect to get.
I think he should have gotten more..probably at least a year, but am not going to scream the sky is falling because of it.

Standard method in these cases is "Spare the Commons, Hang the Lords".
Those who commited acts of violence, carried weapons, or can be fingered as being in a leadership position will get much tougher sentences.

Was gonna say 5 years ain't long enough for even a regular dumbass, but I see you said minimum.

Eight months will still give him a criminal record which will follow him around, potentially limiting his employment prospects, for the rest of his life

It also means he has had his first strike, which makes me wonder if any of these 570+ morons have criminal records with two strikes already, because under Federal Law 18 U.S.C. § 3559(c), a conviction here would be strike three - potentially life imprisonment.

I'm sure at least some of them will make a spectacle of themselves, denying the authority of the court, claiming to be the victims of the Great Liberal-Communist Plot, et cetera.

I don't know. I'm sure there'll be plenty of smalltime employers willing to treat him to a job and congratulations for being part of that mob.

At least one is making incomprehensible sov-cit filings, so that'll be fun.

Unfortunately the Being Bloody Stupid Act of 1581 does not apply to the USA.

Yes but I am unsure as to what the current equivalent would be to Jaimie Lannister trying to convince the Blackfish to spare his men and surrender or he'll siege the castle is supposed to be exactly right now.

"Trump surrender or we'll try in a court of law and give them short prison sentence one of your followers an hour!" doesn't exactly have the same oomph.
