I have doubts...Re: Are presidental self-pardons legal...
It's a pretty fair bet.My guess is that it will be tested this time.
That Stubby McBonespurs might try self-pardoning wouldn't be surprising. But to test it, the federal government would have to 1) decide to bring a case against Trump, and 2) push for it to get to the supreme court. I can see Biden deciding not to follow through with all that because he wants to "heal the nation".
The trouble is, that would make Pence look like he actually has principles (if only for a brief amount of time), when in reality he is as much of a scumbag as the rest of Trump's enablers. My dream scenario is Trump resigns because Pence said he would pardon him and then Pence doesn't.
Oooops!
Plus, what would be in it for Pence? If Trump resigns and makes Pence president and Pence doesn't grant him a pardon, if/when Trump does get charged it will remind people that "oh yeah, you stood by while a con-artist wrecked the country". He'd be better off to grant the pardon in hope that it would curtail any criminal proceedings, so he could claim "There is no proof he is a criminal... the pardon was to prevent a witch hunt".
