I'm betting that during the next sentencing hearing, Sullivan will play his part and probably not sentence Flynn to prison time. Sullivan's rant probably works in Flynn's favor.

It depends on what else he gives Mueller between now and then. If nothing much, I'll wager he'll give Flynn at least 2 months. He was pretty pissed off.

You might be right. It is highly unusual for a judge to not follow a defense/prosecution agreed upon recommendation.

I definitely believe knowing what I know that Flynn deserves some prison time. That said, unlike TBD, I'm fully aware there is one hell of a lot I/we don't know as of yet. So my personal judgement might be faulty.
 
Judges are not above the law.

Judges should not be making stuff up in order to jaq off

What law did the judge break? That the judge was disgusted with the criminal offense General Flynn committed is quite reasonable. It frightens me that someone with the position of NSA could be compromised by foreign governments. It bothers me that Flynn could be so unprincipled that he would:

1. Change foreign policy positions for personal enrichment which is clearly what General Flynn did in regards to Turkey.
2. Be willing to fight for the extradition of a human being to another government where that person would be almost certainly be imprisoned, tortured and very likely executed FOR MONEY.

And this doesn't touch what he may have been doing in service to Russia.

Any American who is not utterly shocked and dismayed that he was then allowed to remain in the post of National Security Advisor for EIGHTEEN DAYS before he was fired doesn't deserve to call themselves a patriot.
 
He's just parroting Trump's spin that this is all persecution and personal attacks.

I bet you could bilk Trump supporters for a good chunk of change. Get to the bottom of how the FBI could trick a patriotic general into accidentally lying and then admitting it.

Yates was dismissed in the interim for not defending Trump's Muslim Ban in court (A huge blow to the political independence this particular executive department is supposed to have).

They only acted on his exposure when WaPo published it, then he resigned within hours.

In the first 5 minutes Popehat calls the narratives that the judge was going to rebuke the prosecution in the Flynn case "nutty", "ridiculous", "nothing to do with the facts", "junk reporting", and makes it clear that anybody with any knowledge of the law should have been expecting Sullivan to act the way he did once he asked for the 302s. He goes on to say that the argument that there was misconduct by the FBI is "specious", "entirely ridiculous", and that "there's no basis in the law for it whatsoever".

WRT Sullivan's comment that Flynn was working as an unregistered Turkish agent while in the White House and the question about treason, he says "he was just going off; he was very angry", "he talked himself into something stupid and, to his credit, he later walked it back". He also says that anybody with any experience in front of a judge wouldn't be surprised at all, because judges are human beings and therefore act like human beings. So, again, not a surprise to anybody who actually knows anything about the practice of law. No suggestion that he should recuse, or that it indicates bias of any kind.

Just listened to that very informative podcast.

The difference between a real lawyer and a cargo-cult lawyer (as exemplified in this thread) is very stark.

One has a thorough understanding of the theory and practice of the criminal law, the other knows some of the legalese and can look up various statutes on the 'net but completely lacks the background knowledge to piece things together. Sad.

Technically, the only reason why Flynn didn't commit treason is because the US didn't declare the Russian attack on the elections an Act of War.
The same behavior would have been treasonous if the administration had adopted a different posture.
