New SCOTUS Judge II: The Wrath of Kavanaugh

Oh dear, you think that Leland and the FBI lied?

Resistance!

Here's the original story. Note that it doesn't quote Keyser or the FBI.
A person close to the former classmates said it was her understanding that mutual friends of Dr. Ford and Ms. Keyser, including Ms. McLean, had contacted Ms. Keyser after her initial statement to warn her that her statement was being used by Republicans to rebut the allegation against Judge Kavanaugh. The friends told Ms. Keyser that if she had intended to say she didn’t remember the party—not that it had never happened—that she should clarify her statement, the person said, adding that the friends hadn’t “pressured” Ms. Keyser.

Lotta distance there.

Slow your roll, neighbor. It's not a game, it's a metaphor.

There's a recurring theme in my thoughts about the current state of partisan politics. It seems like progressives generally expect me to genuflect for their tolerance, while also making it clear that they will never actually tolerate me.

"I can't trust or respect you, because you voted for Donald Trump."

Oh honey, you convinced me that you wouldn't trust or respect me no matter what I did, long before Trump came along.

"Kavanaugh should withdraw, otherwise he'll defile the Court."

Oh honey, you convinced me long ago that any conservative justice would defile the Court in your eyes.

Why should Kavanaugh kowtow to your demands to do the "right" thing, when you've made it clear that you have nothing of value to offer in return?

ETA: The rhetorical you, not you personally, phiwum. I know that individuals vary widely on this. I'm referring more to the overall tone of the discourse.

One of my dearest pals voted for Trump. I wish that wasn't so. But, still, he's my pal. I promise you that I will never call you bad for voting for Trump. I think it was a disastrous choice, but I don't regard you as a bad person for that choice.

Kavanaugh, on the other hand, damned well ought to "kowtow" to the general rules that the court is non-partisan. He ought to avoid partisan bias in his public displays. This is important. The appearance of non-partisan judgment in the highest court is essential.

Thanks for the ETA, Prestige. You know that I regard you as a more or less decent guy, despite our disagreements.

All of which is besides the point: is it wise to confirm a anti-liberal conspiracy theorist to SCOTUS?
It's probably already been done. I mean, we didn't used to find out so much about people. In doing a little research I came across an Atlantic article praising William Rehnquist for his administrative skills, helping people get along better.

Rehnquist the Great?
By refusing as chief justice to give interviews except about his books on Supreme Court history, and by devoutly guarding his privacy, he has helped maintain and enhance the Court's carefully cultivated aura of mystery and authority.

Well, the Kavanaugh debacle does a lot to shatter that particular "aura." Is that a good thing or a bad thing? I honestly don't know. I know I wrote earlier that I felt like he might as well be confirmed, but actually, looking at the vote, I feel a little sick about it. I wish it was someone else, someone not so polarizing. I'm squeamish about the way everyone has been backed into various corners. I can't help but wonder, why this guy? Is polarization the whole point? Who benefits from that? China? Russia? Not the U.S., I'm pretty certain.

Ironically, Ford would have gotten more privacy and fewer death threats if she had chosen to testify to the cops instead of to Congress. And in addition to keeping Kavanaugh off the Court, she might even have gotten justice.

Sure, were she a confident young woman back in the day, things would have turned out different. Now, I'm sure that were I in her shoes back then, it would have been a challenge to do what you suggest.

But, honestly, none of this matters. What matters is whether or not Kavanaugh ought to be on the Court. And, in this regard, the easiest questions are whether he lied under oath and (even easier) whether he publicly displayed the temperament of a Justice in the highest court.

But this must never be spoken of, all that matters is people who aren't Kavanaugh and how they are bad.

I actually went the other way: Super straight-edge all through high school. No drugs, no alcohol, no sex... It wasn't even clear to me how to go about doing those things, so I basically just threw it all on a back burner to examine at some point in the future, after I'd figured out what I thought were the more pressing issues in my life. Wasn't till my mid-20s that I got laid for the first time, got drunk for the first time, got high for the first time.

In New Jersey, all of the above happen with or without your consent.

Travis, you have a problem, and it isn't Kavanaugh. Make some changes to your own life, it's unhealthy to be this sensitive to political winds.

It's probably already been done. I mean, we didn't used to find out so much about people.

Let's do away with the public hearings. Do everything in writing. The hearings are just a forum for posturing by Senators, they aren't actually productive.

It is unhealthy that I'm upset that we now have a Supreme Court that will soon rule that only white Christian men have basic rights? That only men will be allowed to own property, vote or read books in public? That soon we will start burning people at the stake again for various religious crimes? That soon this nation will be an unlivable hellhole with tens of millions dead in the concentration camps that will definitely also be ruled as "constitutional?"

I choose to be upset about the nightmare that is about to descend on this nation.

I know how you feel.

I don't want bullies running the country. Whether they're Republicans or Democrats. But I'm not sure what to do about it, except vote.

...
The point, though, is that it is normal. I do know plenty of people who used to drink a lot, and who look back befuddled but fondly on those days, even though they know that it was really stupid and they would never do it again. I myself quite literally sing the praises of beer and other alcohol on a regular basis. (i.e. I sing drinking songs).

Does he have a drinking problem today? There's no reason to believe he does.
Yes there is, but you refuse to even acknowledge his temperament might indeed be a symptom of an ongoing problem.

Any talk about it is just a willingness to believe the worst about someone because he's "on the other side".
Or deny the worst with claims like, "my friends don't have a problem so he wouldn't."

It's not inevitable. It's really not. If this isn't hyperbole, I'll go out on a limb and say ... you're wrong. That stuff isn't going to happen.

Show us on the doll where the confirmation process touched you.

More seriously, though: Do you remember the point at which you thought there was a real chance Kavanaugh wouldn't get confirmed?

Do you remember the point at which you realized it was going to happen after all?

Don't become a parody of yourself. Nothing remotely like that is going to happen. The most disruptive thing he might do is overturn Chevron deference, but that is so far from your fears as to be irrelevant to them.

Get professional help if you need to, but make some changes in your life. This won't end well otherwise.
