It is applicable here. Mueller indicted on charges he's not ready to prosecute on. He's left trying to delay a trial he called for, using excuses that normally the defense, not the prosecution, would use.

This is separate from the evidence sharing issue (I never claimed they were the same), but it's quite real.

I agree that in order to have a fair trial, the defense should have the evidence the prosecution plans to use against them, so that they can prepare an adequate rebuttal. The prosecution should not be required to share the evidence with anyone other than the defense, before the trial.

The prosecution is not, what the prosecution is trying to do is limit what the defense attorneys working on the case can do with the information, up to and including sharing it with their client.

Of course Mueller isn't going to say he's not ready to prosecute, but that's obviously the case. The reason to delay a case because of problems with the summons is if the defense isn't ready to proceed because problems with the summons delayed the defendant from being notified in time to prepare. But the defense is ready. It's a joke that Mueller is asking for a delay basically on their behalf when they don't want one. That's why his motion was denied.

You mean the defendant who was represented by counsel standing in court and therefore clearly and unmistakably accepted the summons and voluntarily appeared in court? That defendant?

Mueller's argument was what legal beagles call "specious" or in lay man's terms, *********** stupid.

Can you explain to me the specific process in receiving a summons, and what the process is once you receive the summons to proceed? The politico article that Zigg was kind enough to self-own himself with has some pretty good details on how Mueller was trying to strictly follow protocol.

You're in denial. It's obvious Mueller isn't ready. If he was ready, he wouldn't ask for a delay. That is the entire point of asking for a delay: to get more time to get ready. It doesn't take any special powers to recognize this, nor is it any sort of conspiracy theory. It's all quite ordinary, and quite obvious.

If you aren't suffering from recto-cranial inversion, that is.

If that's true, then it's wrong. If the defendant were to represent himself, the prosecution would have no choice but to share their evidence with him. I don't see how engaging legal assistance changes this.

The efforts to send the summons was following protocol. But the entire point of that protocol is to ensure the defendant's right to a proper legal defense. When the defense doesn't want a delay, asking for one on their behalf is not strictly following protocol. There is no protocol that requires Mueller to request a delay. It's an excuse, a transparent one that the judge wasn't buying, and with good reason.
