Good skepticism on the memo actually existing. Now, apply that to your earlier question, why didn't Comey disclose it? How in fact do you know he didn't disclose it? There's no legal or moral obligation to report to the *public* at every step in an investigation. You would not know if he shared it in confidence with law enforcement officials.

None of us has the the whole picture.

Actually we do know that he did exactly this. Unless multiple news sources got it wrong.

The DOJ, didn’t exist until 1870 and the FBI started in 1908.

I don't think that's true. Ignorance has never been an excuse for violating a law. However, his intent is very important.
