"Ivanka Trump is quietly staffing up, and she’s filling out her team in the West Wing with former officials from President George W. Bush’s administration.

In addition to her close adviser Dina Powell, who served as assistant to the president for personnel in the Bush White House, the first daughter — who now serves as a special assistant to the president — has hired a chief of staff who worked under Bush’s education secretary, Margaret Spellings."

Looks like Trump isn't even trying to hide the nepotism. How is this even legal? I believe the only reason Trump is allowed to be above the law is Republican compliance.

I looked this up. The Justice Department already concluded (on Jan 20th) that the anti nepotism law doesn't apply to the White House.

You have asked whether section 3110 of title 5, U.S. Code, which forbids a public official from appointing a relative “to a civilian position in the agency . . .
over which [the official] exercises jurisdiction or control,” bars the President from appointing his son-in-law to a position in the White House Office, where the
President’s immediate personal staff of advisors serve. We conclude that section 3110 does not bar this appointment because the President’s special hiring authority
in 3 U.S.C. § 105(a) exempts positions in the White House Office from section 3110.

3 U.S.C. § 105(a) reads:

(1) Subject to the provisons [1] of paragraph (2) of this subsection, the President is authorized to appoint and fix the pay of employees in the White House Office without regard to any other provision of law regulating the employment or compensation of persons in the Government service. Employees so appointed shall perform such official duties as the President may prescribe.

Honestly, it seems very clear to me that Trump can legally give anyone he wants a job in the White House including Ivanka and Kushner. I don't even think it is possible to make an argument to the contrary that makes any sense.

The law in question doesn't ban hiring family members totally, it just states that if you do, that they aren't allowed to be paid. Of course their staff can be paid...

The law doesn't even apply to the White House. Trump can decide to pay her whatever he wants, up to $187k/year.

It is a very unnerving precedent. Dictators often give their family members powerful positions in their governments. But wow, the President appears to have more power than they should. I guess law-makers did not see a Trump Presidency coming when they made this exemption.

Honestly, better them be his WH top advisors than crazy ideologues like Steve Bannon and Stephen Miller.

Sounds like she has better judgement than her dad. Ivanka 2024? 2020?

Strongly agree. Obviously I have absolutely no inside knowledge, but what public information we know about Ivanka and her staff picks suggests standard, normal modern Republicans. That's orders of magnitude better than conspiracists and extremists.

:wwt

Seriously?

No, not Ivanka 2020 or 2024, because having better judgement than her dad only makes her another face in the crowd.

Before we start electing faces in the crowd because we've seen them on TV, they may be vaguely associated with Republican values, and they might have better judgement than Trump, we should declare an idocracy and then launch preemptive nuclear strikes on both Russia and China, and just get this crazy crap over with in the least lingering manner possible.

So. Think I might be crazy enough to get elected? Hey, I'm a face in the crowd, and I've got judgement and stuff.

The power to have friends and family among his personal advisors? That doesn't seem very powerful. Dictators often give their family members powerful positions like the head of the military, or chief justice. You know--positions with actual decision-making authority within the government.

Let us know when Trump gives Ivanka the chair of the Joint Chiefs.

Is that when the first stirrings of concern will crease your brow?

Did anyone, including the most ardent trump fan, expect anything less?
While lying his way through the campaign trail, he got his idiot fans chanting 'drain the swamp' those same fans accept, and applaud the corrupt types he now appoints, even the members of his own family you wouldn't trust to make a cup of coffee.
Where's the fuss over his constant trips to his own resorts and accompanying security, at the taxpayers expense?
Sure the media fills spots here and there and, people complain on twitter as per the case for everything nowadays, but it's not exactly throwing the hammer down.
The guy still won't show his own taxes, yet still has support, you think he gives a toss what general public know what he's doing?

Concern about what? You're talking about a dictatorial power grab that is not happening, and that could not happen under the American system of government. I'd get concerned long before Ivanka became chair of the Joint Chiefs of Staff--if your idea of what's going on were at all accurate or realistic.

Most interesting to me is why the nepotism law does not apply to the White House. Why was that exemption thought to be useful?

Probably because all the really important executive roles fall within the scope of the checks and balances of government to fill. The cabinet must be approved by Congress.

Because it is a separation of powers morass. People in Congress don't want to weaponize executive branch salaries yet.

It's for the best. Ivanka and hubby will be the de facto President for the next four years. Soon enough everyone will have learned that, regardless of Trump's back-and-forth on the issues, the line taken by the royal couple will eventually prevail. That is, once the orange dummy has been given a pacifier and a mirror to hold him over to the next public rally, his real function as the fact-free GOP ranter in chief.
