That page certainly sounds like the SunCell is complete and operating and producing electricity, doesn't it. But it isn't. That's one of those so - called "forward looking statements". People who have been following relatively closely know this. The SunCell *has* been operating, but it hasn't been operating as a closed dome unit, producing electricity. There has been a hole at the top of the dome for monitoring the reaction and actively venting heat and vapour out. It can operate like that for hours. But again, that isn't the closed dome, white hot, high power stage of product development. I'm guessing a couple of months before the dome is closed. Then once it is closed, there will be further refinements to make, so a few more months of tweaking after that. Then it's off to the races.

Would this race involved a greased pig trying to be caught by an arm less blind man?
 
I hope that they were at least able to complete another round of funding before this latest set back arose. :)



Oh, I'm sure this "setback" will make an excellent excuse for needing MORE funding. Expect another round of dog-and-pony shows.

As they're not using the heat to power anything, why does he want to trap it? Why not vent it away safely? Or, indeed, use it as well as the light. What about the top being open means that the light being generated can't be used for power?

Okay, I've done a bit of digging into "forward looking statements" and US law. I'm not a lawyer or an expert, so I'd certainly appreciate input from anybody who is. But this is what I've found so far. It seems that, in general, "forward looking statements" put a company at risk of being prosecuted for fraud, however there is a legal safe harbour for such statements, as set out here.

The most relevant part of that appears to be this:

(1) In general
Except as provided in subsection (b) of this section, in any private action arising under this subchapter that is based on an untrue statement of a material fact or omission of a material fact necessary to make the statement not misleading, a person referred to in subsection (a) of this section shall not be liable with respect to any forward-looking statement, whether written or oral, if and to the extent that—
(A) the forward-looking statement is—
(i) identified as a forward-looking statement, and is accompanied by meaningful cautionary statements identifying important factors that could cause actual results to differ materially from those in the forward-looking statement

In other words, any "forward looking statements" have to be identified as such in the text of the statement itself, and be accompanied by warnings about what could change in the future to make the outcomes described in the forward looking statement not come to pass.

So, markie, are you sure you want to call that a "forward looking statement"? Because if that's what you're calling it, then it seems to me that you're accusing Mills of committing fraud, as per United States Code 15 Section 78u-5. Are you accusing Mills of fraud?

I always thought "that theory has a hole in it" was just a saying. And here it is, brought to life. The theory literally (in the literally sense of literally ) has a hole in it.

The graphite dome has a hole in the top of it. Nothing to do with the theory.

Context, context. I could have a company webpage that says it has developed a rocket capable of going to Mars and back. Is that fraud? No. It is defrauding no-one. It would be forward looking, loosely, not legally, speaking.

If I had material specifically for investors to evaluate, then things might be different.
