Because, as has been repeatedly pointed out previously, and through the statements of experts, the FBI doesn't know what the investigation is until it gets to the end. Turns out, without a crime, it's not a criminal one.

I think an expert would refer to a an investigation to determine whether a crime has been committed a "criminal investigation."
Judge Sullivan did, he knows what he is talking about.

No one directly associated with the investigation has called it a "criminal investigation".
After a tremendous amount of work over the last year, the FBI is completing its investigation and referring the case to the Department of Justice for a prosecutive decision.
